3 things to know about probate in Oklahoma:

1. A Will does not avoid probate. It’s a letter to the judge explaining how you want your estate handled.

2. Not every estate requires probate. How assets are titled and whether they have beneficiaries can make a major difference.

3. Planning ahead can save time and expense. Trusts, beneficiary designations, and proper asset titling can often simplify or avoid the probate process.

One of the biggest estate planning mistakes I see isn’t failing to create a trust.

It’s creating one…and then never putting anything in it.

A trust is a legal document, but simply signing it doesn’t automatically move your house, bank accounts, mineral interests, or other assets into the trust.

If assets aren’t properly titled or otherwise coordinated with your estate plan, your family may still end up dealing with probate…the very thing you created the trust to help avoid.

Estate planning isn’t just about having the documents.

If you created a trust years ago and haven’t reviewed how your assets are titled since then, it may be worth taking another look.
