TWO DEATHS REPORTED IN MULTI-VEHICLE CRASH CAUSED BY LOW VISIBILITY DUE TO SMOKE FROM A BURNING FIELD

If you you’re going to burn a field near an Arkansas roadway there is an Arkansas statute you must follow. The statute follows in its entirety, but the skinny is that you must notify the Arkansas Forestry Commission of your intent to burn:

§ 20-22-302. Notice to Arkansas Forestry Commission of intent to burn forest vegetation

(a)

(1) Any person in this state who desires to burn forest vegetation, including debris from land clearing, shall notify the Arkansas Forestry Commission of the person's intention to burn. Notification of the proposed burning shall include the time and location of the intended burning and other facts which the person or the commission may deem relevant.

(2) This notification requirement shall not apply to the "open burning" of "yard wastes" as those terms are defined in §8-6-1701.

(b) The landowner or other person having charge of the land or his or her agent shall be present and in attendance at the time of the burning.

(c) There shall be no liability on the part of the State of Arkansas, the commission, or any personnel of the commission for damages caused by the burning of forest vegetation under the provisions of this section.

(d) It is the intention of this section that the commission may assist or advise local landowners or their agents in the burning of forest vegetation.

(e) This section shall not apply unless the forest vegetation or debris from land clearing to be burned weighs at least one (1) ton.

Generic vs. Name Brand?

Generics are cheaper, but what if they cause you harm?
In a nut shell, if a generic drug or medical device causes you harm you cannot sue the generic manufacturer.

Under the FDCA (Federal Food, Drug, and Cosmetic Act) there is the requirement that all actions to enforce claims under the act must be brought in the name of the United States. We lawyers continually try to urge exceptions to this draconian stance, but most times, a generic manufacturer cannot successfully be sued if it has not altered the recipe relative to the active ingredients or messed with the warnings approved by the FDA for the original manufacturer.

So, when you're deciding whether to spend the extra money, factor in the possible consequences.

Camp Lejeune Water Contamination Claims

This is a big deal.

Here’s the skinny, followed by a link to the entire federal act:

Marine base, Camp Lejeune, North Carolina

Applies to anyone who was stationed, worked, or resided there for at least 30 days during 1953-1987.

Assumptions:

That you used and were affected by the contaminated water;

If you were a member of the military, that your qualifying condition was caused by the contaminated water.

Qualifying conditions may include, but are not limited to:

Adult-onset leukemia;
Aplastic anemia;
Bladder, kidney, and liver cancer;
Multiple myeloma;
Non-Hodgkin’s lymphoma;
Parkinson’s disease.
Attorney fees are capped at 20% for settlements, 25% for judgments.

Camp LeJeune Drinking Water Contamination

At Camp LeJeune and Marine Corps Air Station (MCAS) New River in North Carolina, two on-base water wells were shut down in 1985 when it was determined they contained the following chemicals:
Trichloroethylene (TCE)
Perchloroethylene (PCE)
Benzene
Vinyl Chloride
Other Compounds
If you are a veteran, reservist or guardsmen that served at Camp LeJeune or MCAS New River for at least 30 cumulative days from August 1953 through December 1987, you may be entitled to compensation if you have been diagnosed with one or more of the following:

A good way to understand the big picture for any mass tort case is to see what criteria are settled upon by the steering committee, appointed by the Court handling the multi-court litigation.

The criteria for the CPAP, BiPAP and ASV (adaptive-servo ventilation) machines are as follows:

• Must have used a Philips Respironics CPAP, APAP, BiPAP device, or a mechanical ventilator;

• Must have used the device for a minimum 12 months before the diagnosis of the following injuries:

• Acute Myeloid Leukemia, Blood Cancer, Bone Marrow Cancer, Chronic obstructive pulmonary disease (COPD);

• Esophageal Cancer, Hematopoietic Cancer, Laryngeal Cancer, Leukemia, Lymphatic Cancer, Multiple Myeloma, Non-Hodgkin’s Lymphoma, Nasal Cancer, Nasopharynx cancer, Sinus Cancer, Soft Palate Cancer, Throat Cancer, Tonsil Cancer, Recurrent Pneumonia, Kidney damage(Acute or sudden), Kidney failure(Acute or sudden), Liver damage, Liver disease, Lung damage, Lung disease, Interstitial lung disease, Acute Respiratory Distress Syndrome (ARDS), Pleural Effusion, Reactive Airway Disease (RAD), Respiratory failure, Sarcoidosis;

• Must have used the device for a minimum of 24 months before the diagnosis of the following injuries:

• Thyroid Cancer, Papillary Carcinoma;

• Must have used the device for a minimum of 36 months before the diagnosis of the following injuries:

• Bladder Cancer, Brain Cancer, Colon Cancer, Kidney Cancer, Liver Cancer, Lung Cancer, Re**al Cancer, Stomach Cancer, Testicular Cancer;

• Must not have been a smoker in the past 10 years if diagnosed with Lung Cancer

• Must currently be younger than 81 years of age.


I admit that when this particular mass tort case emerged I was not that impressed. But when you consider the number of people who have developed cancer, from using these machines, a warning to friends and family is warranted.

If you’ve gotten a recall notice, heed it. If yours is one of the recalled models, stop using it.
