A title problem does not have to end a transaction. Most defects we encounter in Arkansas are correctable, provided they are identified before closing rather than during it.

Common issues include:

▪️Heirs never accounted for in a prior transfer
▪️Old liens or mortgages paid but never released
▪️Legal descriptions that conflict with adjoining parcels
▪️Deeds missing a signature, a notarization, or a spousal release
▪️Breaks in the chain of title going back decades

Lenders, realtors, and closing agents are welcome to bring these to us early rather than at the closing table.

Seeing a loved one's name in the newspaper can come as a surprise during probate. It is a normal part of the process, and in most cases Arkansas law requires it.

When a personal representative is appointed, notice must be published so that creditors and other interested parties learn the estate has been opened. The notice identifies the decedent, gives the date of death, and starts the six (6) month period during which claims against the estate must be filed.

Not all probate cases are alike, and wrongful death probate in Arkansas is its own discipline.

A wrongful death recovery does not simply pass to the family. An estate generally must be opened, a personal representative appointed, and Arkansas heirship rules applied to determine who is entitled to the proceeds. Creditor claims add another layer, because Arkansas law bars most claims against an estate unless they are filed within six months of the first publication of notice to creditors, and that period affects how and when a settlement can be distributed. Add wrongful death to the mix an inexperienced individual can overlook receiving additional creditor protections.

For personal injury firms, sequence matters. Involving probate counsel before filing is an important step.

Unclear ownership can derail a sale faster than almost any other title problem. A quiet title action asks an Arkansas court to determine who actually owns a piece of property and to resolve competing claims against it.

These actions most often arise with inherited land, long-vacant property, and parcels with gaps in the paper trail. A deed missing for decades, a legal description that conflicts with the neighboring parcel, or an heir who was never accounted for can each cloud a title enough to stop a closing.
