Legacy Planning Law Group

Legacy Planning Law Group We are an Estate & Elder law firm that likes to take the TEAM approach to help our clients.

Legacy Planning Law Group is a Jacksonville firm specializing in estate planning, elder law, and probate law. Attorney Bill O’Leary and his team have helped hundred of families prepare everything they need to preserve their legacies: establishing revocable living trusts (and the associated trust funding), last will and testaments, designations of the executor and trustees, power of attorney, advan

ced directives, and healthcare surrogates. For those whose loved one passed away without creating an estate plan, the probate and estate settlement experts on the team will make the court process as painless as possible. Legacy Planning Law Group also offers assistance to clients that are planning for (or dealing with) concerns related to advanced age planning: long term care solutions, Medicaid planning, designating a healthcare proxy, establishing a lady bird deed, creating a qualified income trust, and whatever else needs to be done to deal with the legal challenges that crop up during the golden years. For all Legacy clients, the firm is ready to do whatever it can to help them protect their families and preserve their legacies.

A hospital says your mother can't safely go home. Nursing care runs thousands a month. Does she earn too much for Medicaid to help?

Most families ask that question in the middle of a crisis, when choices are already narrow. Florida caps monthly income for long-term care Medicaid, and those limits change most years.

Being over the limit doesn't always mean no. A Qualified Income Trust may open a path, and spousal rules can protect the husband or wife still living at home. Income is only part of the review — assets, medical need, and five years of financial history all get looked at too.

In our latest article, Legacy Planning Law Group breaks down how Florida defines income and what Jacksonville families can do if they land above the line.

Has the person handling your loved one's estate gone quiet? No updates, no filings, no answers.

It happens more often than families expect. Months slip by, an empty house keeps collecting bills, and no one knows whether a case was ever opened with the court.

You have more say than you might think. Florida sets deadlines for filing the will and listing estate assets, and beneficiaries can ask the court for a full accounting or to replace someone who isn't doing the job. Naming backup executors now can spare your family in Jacksonville the same headache later.

In our latest article, Legacy Planning Law Group explains what an executor's silence can cost you and the steps that may get a stalled estate moving again.
