🔻What happens if you were married outside of Canada?
✔️I often have people ask me whether there are any implications to the fact that they were married outside of Canada and whether the court in Ontario will recognize their marriage. The short answer is yes. The courts in Ontario will recognize a marriage that was done outside of Canada as long as there is proof of it or proof of a good faith marriage, and it will be treated exactly the same as any other person who was married here in Ontario.

🔻What do I do if my spouse isn’t paying child support or spousal support?
✔️If you have a court order or agreement requiring your spouse to pay support, you may ask that it be enforced by the Family Responsibility Office, which is a government agency in Ontario that enforces court orders and agreements for the payment of support. If the payor refuses or fails to pay, the Family Responsibility Office may suspend their driver’s license, suspend their passport, imprison them, as well as take other enforcement actions. If you do not have a court order or agreement for support, then you must proceed with a court application to seek this relief from the court and then seek to enforce it through the Family Responsibility Office. Do I need to hire a lawyer or go to court immediately after we separate?
People often ask me whether they need to go to court immediately after they separate, and while there’s no legal requirement to do so, it is important to note that some of the claims that are typically made in a family court case are time-limited, meaning that you cannot bring them whenever you want. For example, if you want to make a claim for equalization, also known as division of assets, you must make that claim within six years of separation or two years after divorce. Likewise, many other property claims may be subject to a two-year limitation, which means that you must bring those claims within two years of separation. Do I need to wait a year after separation to hire a lawyer or go to court?
Hi, my name is Ash Mazinani. I’m a divorce and family lawyer in Toronto. One of the most common misunderstandings that clients bring to my office is that they tell me that they were told or that they read online that they need to wait one year after their separation before they hire a lawyer or go to family court. This is based on a misunderstanding of the law. The law in Ontario provides that the court cannot grant a divorce order until at least one year after the date of separation unless special circumstances apply. However, the divorce is usually the last thing that happens in a family court case. The fact that you have been separated for less than a year does not mean that you are unable to hire a lawyer or go to court to deal with your issues.
