🔻 Do I need to hire a lawyer or go to court immediately after we separate?

✔️ People often ask me whether they need to go to court immediately after they separate, and while there’s no legal requirement to do so, it is important to note that some of the claims that are typically made in a family court case are time-limited, meaning that you cannot bring them whenever you want. For example, if you want to make a claim for equalization, also known as division of assets, you must make that claim within six years of separation or two years after divorce. Likewise, many other property claims may be subject to a two-year limitation, which means that you must bring those claims within two years of separation. 🔻 Do I have any rights if we weren’t married?

✔️One of the most common questions that I get is whether people have any rights if they’re not married to their partner. In Ontario, the law provides that married spouses and unmarried spouses do not have the same rights. However, unmarried spouses can still claim spousal support if they can establish that they were in a common-law relationship. Moreover, unmarried spouses can also potentially make property claims against each other’s real estate and businesses if they can establish that they’ve made contributions towards the acquisition, maintenance, or improvement of these assets. To legally end your marriage, you must apply to the Superior Court of Justice for a divorce by:
- Filling out the divorce application;
- Submitting the divorce application to the Court;
- Paying the required court fees;
- Serving the divorce Application and,
- Setting the matter down for a Divorce Hearing.

Eligibility Criteria If you want an Ontario court to officially end your marriage, you can apply for a divorce if you meet the eligibility criteria, including:
- You were legally married in Canada or in any other country;
- You intend to separate or have separated from your spouse, without any reasonable prospect of reconciliation; and,
- You and/or your spouse have lived in Ontario for at least the 12 months preceding your application.

🔻 What happens if I can’t find my marriage license?

✔️I’ve had many clients come to me and tell me that they cannot find their marriage license, or that the marriage license, for whatever reason, wasn’t registered on the day of the wedding by the officiant. And they ask me what the implications of this are. The law in Ontario provides for something called a good faith marriage, which essentially means that the court will operate under the assumption that you were married and treat you accordingly in determining your rights and obligations if you can establish that you had a good faith marriage, which means you intended to be married, you thought you were married, you acted like you were married, and you represented yourself to the community as a married couple. If you can prove this, the court will assume that you were married and treat you accordingly, even if you cannot provide the legal documentation to prove your marriage.
