What if you could decide in advance and in writing how issues would be resolved between yourself and your partner if the relationship deteriorated?
Well, that’s what a domestic contract does. Hi, my name is Ash Mazenanian. In Ontario, there’s three types of domestic contracts. There are marriage contracts, which are signed between parties who either intend to be married or are married.
There are cohabitation agreements, which are signed between parties who either intend to start living together or have already been living together but are not married. And there’s also separation agreements, which are signed between spouses, whether married or unmarried, after they have separated and the relationship has deteriorated. What all of these have in common is that they can impact and alter the parties’ rights with respect to major issues such as parenting issues, custody, child support, spousal support, and division of assets. In order to be enforceable, a marriage contract or domestic contract must be signed, witnessed, and in writing. And it is also good practice for both parties to have independent legal advice from a lawyer and full financial disclosure. Otherwise, you run the risk that a court will set aside or cancel the contract after the separation.
