When children turn 18, the law generally recognizes them as an adult, and parents no longer have automatic authority to make medical, financial, or educational decisions on their behalf. For young adults with special needs, this transition may require additional planning and support, especially when they continue to rely on their parents for everyday care and decision-making.

But full guardianship isn't the only option.

In Florida, families of a loved one with a developmental disability can often use the Guardian Advocacy process, a simpler court process that gives a parent or caregiver authority only in the areas where help is needed.

For some young adults, a durable power of attorney and a health care surrogate designation may be enough, and for others, a Guardian Advocate is more effective.

The right path depends on your loved one's abilities and needs, and the goal is always to support them while preserving as much of their own independence as possible.

Estate planning can feel very far away when you are just graduating high school, in the middle of college exams, or even at the beginning stages of building a career. It tends to get filed under the "someday" category, after the house, the kids, or retirement.

The moment you turn 18, the law treats you as an adult, and that changes things. Even if you don't think you have significant assets, the bigger question is who can legally step in for you if something unexpected happens.

For National Estate Planning Awareness Week, here are the documents that matter for every adult, at any age:

🔸 Durable power of attorney: names someone you trust to handle your bank accounts, bills, and financial matters if you can't.
🔸 Health care surrogate designation: names the person who can make medical decisions for you, since parents don't automatically keep that authority once you turn 18.
🔸 HIPAA authorization: allows doctors to share your medical information with the people you choose.
🔸 Living will: puts your wishes about end-of-life care in writing so your loved ones aren't left guessing.
🔸 Beneficiary designations: your 401(k), workplace life insurance, and some bank accounts pass to whoever is named on the form, no matter what your will says.
🔸 Will: says who receives your belongings and, if you have children, who you'd want to raise them.
