DHS is now clarifying that the recent Adjustment of Status memo is not a blanket policy requiring applicants to leave the U.S. to obtain their green card abroad. 🇺🇸📄

According to DHS, officers still have discretionary authority to make certain decisions on a case-by-case basis, which is something that has always existed in Adjustment of Status cases. ⚖️

For now, Adjustment of Status applications are continuing to proceed normally. However, this does signal that USCIS may place greater emphasis on discretionary factors when reviewing cases.

This is also a reminder not to panic every time a new immigration policy announcement comes out. Guidance can change quickly, especially after legal pushback and public scrutiny. 👀

A lot of people are panicking after the new USCIS memo on Adjustment of Status cases, but here’s what we actually know right now:

A USCIS memo does NOT rewrite immigration law. Adjustment of Status still exists, and officer discretion has always been part of these cases.

What’s creating uncertainty is the memo’s vague language about “extraordinary circumstances” because USCIS has not explained how officers will apply it yet.

We are seeing some officers ask more questions at interviews and some applicants not getting same-day decisions, but every case is different and it’s still too early for people online to make extreme predictions.

This is why proper case preparation matters more than ever.

Stay informed. Don’t panic. Wait for more guidance.
