Last week a Federal Court found the Executive Order instituting a $100,000 fee for H-1B Visas to be unlawful.

Instituted in 2025, the increased fee has caused many employers to stop hiring, withdraw job offers, and abandon H-1B Visa sponsorship altogether.

Although the Trump Administration has said they will appeal this recent ruling striking down the fee, this decision can potentially provide a path forward for H-1B visa holders, or applicants whose employers have paused sponsorship.

Expedited Removal is a fast-track process that allows U.S. immigration officials to deport certain noncitizens without a hearing before an immigration judge.

Under the expanded policy now in effect, this applies to people who entered the U.S. without inspection, lack valid entry documents, or cannot prove they’ve been in the U.S. continuously for at least two years — and it can happen anywhere in the U.S., not just at the border. This includes some parolees whose parole has ended.

USCIS has issued new guidance emphasizing that adjustment of status is a discretionary immigration benefit.
For green card applicants filing Form I-485 from inside the United States, this may mean closer review of the full immigration history, prior status issues, visa compliance, family ties, and other positive or negative factors.
If you have a pending adjustment of status case, are preparing to file Form I-485, or are unsure whether adjustment or consular processing is the better option, it is important to review your case carefully before taking the next step.

‼️USCIS announced a new policy update stating that adjustment of status will be granted only in extraordinary circumstances.
This may affect people who are applying for a green card from inside the United States, including applicants preparing to file Form I-485, people with pending adjustment cases, and those deciding between adjustment of status and consular processing.
Because every immigration case is different, it is important to review your options before filing, traveling, or making changes to your green card strategy.
