A daycare worker struck a baby’s head against a crib while “disciplining” the child, causing permanent brain damage.

In Baker v. Saint Francis, the court held the employer responsible for the employee’s conduct. Cases involving daycare negligence, child injury, catastrophic injury, negligent supervision, and employer liability can raise serious questions about who should be held accountable.

If your child or family member has suffered a serious injury because of an employee, caregiver, daycare, hospital, or other institution, contact Smolen Law to discuss your case.

A violent employee can become an employer liability problem.

When an employer knows, or should know, that an employee has a history of violence, threats, aggression, or dangerous behavior and fails to act, the responsibility may go beyond the person who committed the assault.

Smolen Law investigates what the employer knew, what warning signs were ignored, and whether negligent hiring, retention, or supervision contributed to the harm.

Accountability does not always stop with the employee.

If you or someone you love was seriously injured because an employer failed to address a known danger, contact Smolen Law. We can help you understand your options and determine who may be responsible.

Dolly Parton gave the world more than music. She gave us joy, generosity, laughter, and a legacy that will be remembered for generations. Her passing is a reminder of how deeply one life can impact so many others, and how difficult it is when a family has to say goodbye to someone they love.

At Smolen Law, we work with families during some of the hardest moments of their lives. In cases where a loved one’s death was caused by negligence or wrongful conduct, families may have legal options and a path toward accountability. Our thoughts are with Dolly’s family, friends, and the millions of people who loved her.

Learn more about wrongful death claims in Oklahoma:

A wrongful death case involves a person who is killed in an accident due to someone else’s negligence or failure to maintain what’s called the "standard of care." Wrongful death actions are brought on behalf of the deceased’s estate, and demand compensation for the loss of a loved one.

A student at Bixby Public Schools was choked by three seniors, not once, but twice, to the point that he lost consciousness and an ambulance had to be called. How would you expect the school to respond?

Parents, talk to your kids before something happens. Make sure they know that if they are being bullied, threatened, assaulted, or feel unsafe, they need to reach out for help. Tell a parent, teacher, coach, counselor, administrator, or another trusted adult. If they see it happening to someone else, speak up and get help.

And if your child has been seriously bullied or assaulted at school and you feel like no one is listening, reach out. At Smolen Law, we help families understand their options and hold the right people accountable when children are not protected.

At What Point Is Bullying Going to Stop? We know bullying is wrong. We know the damage it can cause. We know the warning signs. So why does it continue to happen?

At Smolen Law, we have seen too many cases involving students who were bullied, assaulted, abused, harassed, or failed by the people and institutions responsible for protecting them. We have handled matters involving student-on-student violence, teachers, coaches, school employees, ignored warnings, repeated complaints, and families who felt like no one was listening.

How many times does a child have to ask for help before someone listens? How many warnings have to be ignored before something changes? We know better. It is time to do better. Our children deserve to be safe. If you need help, reach out today.

At Smolen Law, we believe education gives people the ability to question authority, recognize propaganda, understand history, and think for themselves.

Our children deserve better. They deserve an education that prepares them to recognize the truth, challenge bad ideas, and build a future no one else can control.

Oklahoma needs a statewide plan for a statewide problem. Blaming Tulsa and Oklahoma City for our education ranking ignores the challenges facing urban, suburban and rural schools across Oklahoma.

Donald E. Smolen II believes the solution starts with competitive teacher pay, performance incentives, stronger classroom support, accountability and involved parents. Pointing fingers will not move Oklahoma forward. Working together will.

Great Oklahoma teachers deserve to be recognized, rewarded, and paid fairly. But corporal punishment? Don says no. We can teach discipline, accountability, and consequences without physically punishing children.
