The Anaheim Police Dept. will conduct a DUI checkpoint TONIGHT, Fri. 4/24/26 from 6 pm-2 am in "West Anaheim" (wherever that is).

Remember, if stopped, invoke your right to remain silent, insist on having an attorney present before answering questions (they won't oblige this) and don't perform any field sobriety tests or blow into the portable breath testing device prior to your arrest if over 21 years old. If arrested for DUI, it's best to otherwise cooperate and give a blood sample.

The Anaheim Police Department Traffic Unit will
conduct a DUI/Driver’s License Checkpoint on Friday, April 24, 2026, in West Anaheim, starting at 6:00 p.m.

The primary purpose of checkpoints is not to make arrests but to promote public safety by deterring drivers from driving impaired. During the checkpoint, officers will look for signs that drivers are under the influence of alcohol and/or drugs.

The Anaheim Police Department reminds the public that impaired driving is not just from alcohol. Some prescription medications or over-the-counter drugs may interfere with driving. While medicinal and recreational ma*****na is legal, driving under the influence of ma*****na is illegal.

If you plan on drinking, using ma*****na, or taking medications that may impact your ability to drive safely, plan on staying at home. Drivers charged with DUI face an average of $13,500 in fines and penalties and a suspended license.

This program was funded by a grant from the California Office of Traffic Safety through the National Highway Traffic Safety Administration.

Tustin Police Department continues to illegally not published the location of the checkpoint as they’ve been doing for years. Violating one of the prongs of the 8 factor test of checkpoints as held by the US Supreme Court in Ingersoll v. Palmer.

The only reason they get away with this is because the California Supreme Court made up its own test out of thin air stating that if other factors are present in greater amounts, they’ll overlook the lack of another, such as advance publicity, in People v. Banks. 

Tustin, Calif. – On March 6, 2026, the Tustin Police Department will conduct a driving under the influence (DUI) Checkpoint from 6 p.m. to Enter 12 a.m. at an undisclosed location.

DUI checkpoint locations are determined based on data showing incidents of impaired driving-related crashes. The primary purpose of DUI checkpoints are to promote public safety by taking suspected impaired drivers off the road.

“Impaired drivers put others on the road at significant risk,” Sergeant J. Hedges said. “Any prevention measures that reduce the number of impaired drivers on our roads significantly improve traffic safety.”

No matter how minor the case, you still have to fight cases tooth and nail. I’m here at the ugliest courthouse in Los Angeles, the Metropolitan courthouse in downtown LA on a case for driving on a suspended license. From 2016!

Not the most serious case, but I’m filing a motion to suppress the evidence based on illegal traffic stop. The prosecutor has almost no information on how to stop happened or why. That’s why I’m filing the motion.

It’s their burden approved the reason for the stop that discovered the suspended license in the first place. Without a legitimate traffic stop, it’s a 4th amendment violation.

And on some of these old cases that are relatively minor, it won’t be documented well and it will be lost over time. It may not even be able to get the officer here and he may not remember the case. If that happens, then they can’t prove the stop was lawful and they’ll have no evidence that his license was suspended. Then the case has to be dismissed. We’ll see!

Got judicial diversion for a client after an alcohol fueled mistake. If all goes well, her case will be dismissed and her record will remain clean. Part of her sentence was writing an apology letter to the arresting officer. I just delivered that letter today. Contrition, rehabilitation and forgiveness is all part of the process!

Sober people are being arrested for DUI at an alarming rate based on the nonsense that is Field Sobriety Testing.

I've asked every officer I've ever cross-examined in a DUI case, "Can sober people can perform poorly on FSTs?" Everyone of them has answered, "Yes." So what does a poor performance tell you? Nothing!

It's just a gimmick designed to make everyone look bad and justify an arrest. The crazier part is: When a client performs them well, the officer and DA will claim, "It doesn't mean they are not impaired because FSTs are easier than driving!" Ridiculous.
