Your home can be stuck in probate for a year or more. Your family may not be able to sell it, refinance it, or settle the estate until the court process is done.

The fix is a revocable living trust, but only if the deed is actually moved into it. Signing the documents is not enough.

A payable on death designation is often a simple form at your bank, and it can keep that account out of court. But it only works if a beneficiary is named, a backup is listed, and the form still matches your plan.

Many families sign a trust and assume the home is covered. Often one small step was missed.

A name that does not match the deed can trigger a property tax reassessment. An insurance policy that was never updated can put a claim at risk after a fire. A deed that was never recorded leaves the home outside the trust entirely.

A Will alone does not keep your California home out of probate. It tells the court what you want, but the court still has to be involved.

Depending on your situation, a Transfer-on-Death Deed or a properly funded revocable living trust may help. Then check how your home is titled and make sure your beneficiary designations on bank accounts, life insurance, and retirement accounts match your plan.

Having documents is not enough. Your assets have to be coordinated with them.

will and a trust are not the same thing and most families find that out too late. A will goes through probate. A properly funded trust avoids it. A trust controls when and how your beneficiaries receive their inheritance.
