When our 61-year-old client was injured in a January 2023 collision, his doctors told him he had been permanently injured and would require surgery. Despite this somber news, he gave the at-fault driver’s insurance company an opportunity to settle all claims for their $100,000 bodily injury policy limits + the fair market value for his family’s handicapped-accessible van. The insurance company responded by refusing to appraise/account for the handicapped-accessible modifications, and by claiming his injuries were in fact pre-existing age-related conditions. Last week, after SIX prior continuances and a MISTRIAL, our client finally got his day in Court. The defense continued to claim his injuries were pre-existing and degenerative, but attorneys Dane Heptner and Hannah Sowell were able to dismantle their expert’s credibility and medical theories piece by piece. The jury stood with our client and found that he had been permanently injured and that the value of his damages measured $750,000 — more than 5 times what our client had originally proposed as a fair settlement. Because of the insurance company’s unreasonable refusal to accept a fair offer, they will be on the hook for all of the fees and costs our client incurred since the date they turned that offer down.
