USCIS will begin issuing Requests for Evidence (RFEs) based on the new adjustment of status memo saying immigrants must leave the United States and process green cards abroad.
The memo would likely apply to ALREADY FILED and
PENDING cases.
It has been reported that USCIS is already using the new memo framework during ongoing adjudication. The memo states that adjustment of status inside the United States should be treated as an "extraordinary" form of relief and a discretionary benefit.
USCIS says that the ordinary process for obtaining permanent residence is consular processing abroad through U.S. embassies and consulates. This is one of the most significant adjustment of status policy shifts in years.
Adjustment of status is the process of applying for a green card from INSIDE the United States without leaving the country. In the past we were able to adjust status if someone entered the U.S. through a visa.
There are some exceptions: U visas, SIJ, Asylum status cases who want to apply for adjustment of status
