An 18-year-old is rushed to the hospital after a car accident. Who gets to make the call on their treatment?

For one of Elizabeth Sconzert's clients, that wasn't a hypothetical. The patient was a legal adult, unable to make decisions, and had no healthcare power of attorney in place. So alongside caring for the patient, the hospital had to work out who had the legal authority to decide.

Bad outcomes happen even when good medicine was practiced.

But when an unexpected outcome starts to feel like it may become a claim, it can be difficult to know what to do next (and what not to do).

Here are five things physicians and practices should know when an outcome may become a claim, including how Louisiana's process works.

Don't change the chart. Never alter existing records after the fact. It can do more damage than the original event.

Notify your malpractice carrier. Most policies require prompt notice of a potential claim.

Keep conversations limited. Talk it through with your carrier, risk manager, and counsel, not in the hallway or online.

Plan patient conversations. Compassion matters. Loop in risk management before difficult discussions.

Know Louisiana's process. Many claims against qualified healthcare providers go to a medical review panel before a lawsuit can proceed. Consult your counsel about the definitions of the Louisiana Medical Malpractice Act- you'd be surprised what's covered.
