Most people assume their spouse or children will automatically receive everything the way they intend. But under Louisiana law, that’s not always how it works. The state follows a set of rules that depend on heirs, property type, and whether there are a surviving spouse or children. That default plan may not reflect your wishes at all.

We regularly meet families who are surprised to learn how assets are actually distributed when there’s no plan in place. In some cases, it can create unnecessary stress, delays, and even conflict among loved ones. A properly structured estate plan allows you—not the state—to decide how things are handled.

If you’re not sure what Louisiana’s default plan would look like for you, it may be worth having a conversation.

Most estate planning mistakes aren't obvious until it is too late.

- No plan at all or one that's outdated and no longer reflects your wishes
- Beneficiary designations that don't align with your overall estate plan
- No plan for incapacity, meaning no powers of attorney or healthcare directives in place

Without the right documents, your family could face confusion, unintended consequences, or even a court process just to make decisions on your behalf. A complete estate plan covers both what happens when you pass and what happens if you can't make decisions for yourself.

The good news? These are all fixable, but only if you know they exist.

The AP doesn't get all the particulars correct on Long Term Care planning, but it does shed some light on the overall complexity. At our office, we do not simply "spend down." Instead, we look to "convert" as much of your assets into exempt assets under Medicaid and we use gifting and annuity strategies to 1) protect as much of your estate as possible and 2) to avoid probate and the Medicaid Estate Recovery process.
