So I just finished listening to a seminar on the changes of Kentucky no-fault or PIP statute. I am updating pages to my website to explain those changes but, for now, here is a big piece of advice to you, the consumer, in regard to Kentucky car wrecks.

On your own automobile insurance policy, look at buying optional or additional no-fault coverage above the state minimum of $10,000. The reason being that if a medical provider accepts payment from a no-fault or PIP carrier, your car insurance, they are now going to be paid according to the reduced rate under the Kentucky Worker's Compensation fee schedule and they are not allowed to bill you for the balance. So if you are in a bad car wreck with a $50,000 hospital stay and you have $20,000 in no-fault benefits and under the WC fee schedule that 50k bill only totals 20k, the hospital is not allowed to collect the 30k difference from you. Yes, there are arguments against this if the hospital does not receive the full amount listed in the WC fee schedule but if they do receive the full amount under the WC fee schedule, it is a done deal with no way around it.

Think about it. This is a big tool in your favor, especially if you do not have health insurance to reduce a large E.R. bill. Optional PIP is pretty cheap too. I will blog more about this soon but for now, contact your insurance agent and investigate what optional PIP will cost you. I hope you don't have to use it but one of the most important things I can do for you as a personal injury lawyer is to minimize the amount of medical bills you owe; this extra coverage, now gives me big baseball bat to swing on this issue. Thank for listening and yes, hopefully you are never in a car wreck.
