🚨 IMMIGRATION UPDATE: U.S. PAUSES VISA APPOINTMENTS WORLDWIDE

The Trump Administration has announced a worldwide pause/adjustment of visa appointments at U.S. embassies and consulates while the Department of State conducts a new global training program for consular officers. (Internazionale⁠)

According to Reuters, the training is intended to help consular officers more closely evaluate visa applicants, including whether an applicant may become dependent on U.S. public benefits under the public-charge rules. The State Department has not announced how long the training or appointment disruptions will last. (Internazionale⁠)

Some immigrant visa applicants who already had interviews scheduled have reportedly received emails informing them that their appointments are being rescheduled, with a new date to be provided later. (Internazionale⁠)

⚠️ Important: This comes only days after a federal judge struck down the Administration’s separate policy suspending immigrant visa issuance for applicants from 75 countries. The new worldwide appointment pause appears to be related to consular training and implementation of public-charge screening and should not be confused with the 75-country policy that was struck down.

Applicants with upcoming interviews should continue preparing for and attending their scheduled appointments unless they receive official notice from the U.S. Embassy or Consulate that the appointment has been canceled or rescheduled.

We will continue monitoring this development and provide updates as additional guidance becomes available.

🚨 IMMIGRATION UPDATE: Federal Judge Strikes Down 75-Country Immigrant Visa Suspension

A federal judge in New York has struck down the State Department policy that suspended immigrant visa issuance for nationals of 75 countries, finding that the policy exceeded the State Department’s legal authority.

This is very good news for many families whose immigrant visa cases have been delayed or suspended under the policy, which was based largely on concerns that applicants could become a “public charge” in the United States.

⚠️ However, this does NOT necessarily mean that immigrant visas will immediately resume for every country on that list.

Some countries are affected by two separate restrictions:

1. The 75-country immigrant visa suspension based on public-charge concerns — this is the policy that the federal judge struck down.
2. The separate 39-country travel/visa restrictions imposed on national-security and vetting grounds — these restrictions were NOT struck down by this court decision.

🌍 What does this mean for applicants from the 39 countries, including Yemen?

For applicants from countries covered by the separate 39-country restrictions, the lifting of the 75-country public-charge suspension does not necessarily mean that immigrant visas can now be issued.

For example, Yemen was affected by both policies. While this court decision removes the 75-country public-charge restriction, Yemen remains subject to the separate national-security and vetting restrictions affecting the 39 countries.

Therefore, applicants from the 39 countries should not assume that the visa ban has been completely lifted based on this court decision alone.

The situation is developing quickly. The federal government may appeal the ruling or seek a stay, and we are awaiting further guidance regarding how the U.S. Department of State and U.S. embassies will implement the decision.

⚖️ Every immigration case is different. Applicants should determine which restriction applies to their particular case.

🚨 IMPORTANT UPDATE: USCIS CHANGES THE AFFIRMATIVE ASYLUM PROCESS

USCIS has announced a major change to the affirmative asylum system that could significantly affect how many asylum cases are processed moving forward.

What changed?

Previously, most affirmative asylum applicants would:
✅ File Form I-589 with USCIS.
✅ Attend an asylum interview with an Asylum Officer.
✅ If not approved, have their case referred to Immigration Court for another hearing before an Immigration Judge.

Under the new rule, USCIS may now refer certain affirmative asylum applications directly to Immigration Court without first conducting an asylum interview.

Why is USCIS making this change?

According to DHS and USCIS, the goal is to:
• Reduce the affirmative asylum backlog.
• Eliminate duplicate reviews by USCIS and Immigration Judges.
• Allow Asylum Officers to focus on cases USCIS will ultimately decide.
• Speed up processing of the asylum system.

Which cases will be referred without an interview?

At this time, USCIS has NOT published any criteria explaining which cases will be referred directly to Immigration Court.

We do not yet know whether the decision will depend on:
• Nationality.
• How the applicant entered the United States.
• The strength or complexity of the claim.
• Filing date.
• The asylum office handling the case.
• Or other internal factors.

Until USCIS provides additional guidance, there is no public checklist explaining which applicants will receive an interview and which will be sent directly to an Immigration Judge.

What does this mean for asylum applicants?

This change makes it more important than ever to submit a complete, well-prepared asylum application from the very beginning.

Applicants should ensure that their filing includes:
✔️ A detailed and accurate declaration.
✔️ Strong supporting evidence.
✔️ Country conditions documentation.
✔️ Corroborating documents whenever available.
✔️ A clearly developed legal basis for the asylum claim.

You should no longer assume that you will have an opportunity to explain or clarify your case during a USCIS asylum interview.

⚠️ This is one of the most significant procedural changes to the affirmative asylum process in recent years. We are closely monitoring how USCIS implements this new rule and will continue to provide updates as more guidance becomes available.
