The Thai Supreme Court has established the principle that the continuity of employment tenure should be recognized if the employer rehires the employee.

Supreme Court Judgment No. 2924/2535 states that the Labor Court has the authority to protect employees from unfair dismissal. It provides that the court may order the employer to reinstate the employee at the same wage rate they received at the time of dismissal. This implies that the employee must be reinstated in their previous position before the termination. Additionally, the Labor Court's ruling that the plaintiff's length of service should be counted continuously from their original employment before dismissal is in line with this protection.

A will is a declaration of intent by a person regarding their assets and affairs before their death, ensuring that their wishes take effect after they pass away. Such a declaration must be made in accordance with the legal requirements set by law.

Qualifications of a Person Making a Will
There are two main qualifications for a person to make a valid will:

They must be at least 15 years old.
They must not have been declared legally incompetent by a court.
Types of Wills
Under Thai law, a will can only be made in one of the legally recognized forms. The testator (the person making the will) may choose any of the following types:

Ordinary will (written in any form that meets legal requirements)
Holographic will (entirely handwritten by the testator)
Public document will (made before a government official)
Secret will (sealed and declared before an official)
Oral will (only allowed in exceptional circumstances)
Who Are the Heirs?
When a person passes away, their assets automatically become part of their estate and are inherited by their legal heirs. Thai law categorizes heirs into two main types:

1. Statutory Heirs
Statutory heirs are individuals who are legally entitled to inherit from the deceased due to their direct familial relationship. This includes:

The deceased's children (descendants)
The deceased's parents
The deceased's siblings (full siblings and half-siblings)
The deceased's grandparents (paternal and maternal)
The deceased's uncles and aunts
The legally married spouse of the deceased
The law prioritizes inheritance based on these levels of kinship. The closest relatives inherit first, and only if they are absent do more distant relatives inherit.

A legally married spouse always has the right to inherit, regardless of the presence of other statutory heirs. This applies only to spouses who were legally registered as married under Thai law.

If a valid will has not been made, or if it is only partially valid, or if it has no effect, the estate will be distributed according to these legal inheritance rules.

2. Will Beneficiaries
A will beneficiary is a person who is specifically designated to receive certain assets of the deceased through a legally executed will. This person does not necessarily have to be a relative. If the deceased made a will stating that certain assets should go to a specific person, those assets will be inherited by the named beneficiary.
