You know your case – the Judge doesn’t

You’re in family court and you’re about to speak to a judge. You know your case inside and out. You’ve been waiting all morning, and perhaps part of the afternoon, to start talking. You’re ready – or, so you think. Just because you know a lot about your own case doesn’t mean that you’ll be able to present it effectively. The best way to be effective is to be prepared.

The more prepared you are, the better you’re able to represent yourself in court and make a strong and compelling presentation. As a result, the more likely it is that the judge will pay close attention to what you’re saying and to what you want.

Court staff are generally very busy. If you’re rude or upset, they’ll likely respond in the same way.

If you can remain patient and pleasant, stay polite and appreciative, you’ll generally get a world of help. Acknowledge that you’ve been trying to do things right but aren’t sure if you’ve succeeded, and asking for their help will take you a long way. Cooperation is a 2-way street.

✔ Try to remain patient and pleasant with the court office staff
✔ Stay polite and respectful when interacting with them
✔ Acknowledge you’re a bit lost with them if you need help.

This is a great tip for any self-rep going to Court!

A well-prepared self-rep suggests to a judge that what you have to say deserves attention.

The fact that you’re organized in what you have to say, that you’ve given the matter thought, that you probably have fairly realistic expectations and that you’ll not be wasting the judge’s time with a lot of unnecessary talk.

Judges are busy.

They appreciate it when someone shows that they know how to use the time available wisely.

They are more likely to listen to your position and even find in your favour if there is a legal basis to your argument.

Self-reps too often have inadequate or incomplete written material and don’t know how to, or don’t, present their case in a meaningful or effective way to a judge.

Too often self-reps have artificially high expectations or will get into telling the judge how bad the other person is without telling what they want and why they should get it.

There is hope, though. You need to show that you’re not like the typical self-rep. You need to show that:

✔ You have the proper material, and you’re organized
✔ You’re able to recognize what is and isn’t important to a judge
✔ You know and can tell the reasonable things you want a judge to do
✔ You know why the judge should do this
✔ You can present in a clear and effective way to get your case across meaningfully and to your benefit.

Did you know?

The majority of people in family court don’t have lawyers, and it’s only increasing. Even so, self-reps, people who are acting for themselves, often feel very isolated and alone. How could they not when they can sometimes be so disadvantaged, faced to go up against a lawyer who has been practicing for years?

Yet, self-reps don’t quite realize that there are way more people in court without lawyers than those with lawyers.

Knowing that you’re not alone should help you feel a bit less isolated. After all, if they can do it, why can’t you?

Simply recognizing that the system is full of people like you who are getting through it one way or another let you know you can too.

The problem isn’t that there are lots of people who are bumbling their way through a court proceeding.

The question is:
