“You can’t use a criminal charge (and an absence of a conviction) against someone as “evidence” in a civil proceeding,” writes our associate. ”Sounds reasonable,“ yet we often have to argue/teach this in civil proceedings. A great many civil litigators don’t often go to trial, therefore aren’t as familiar with the relevant rules, especially rules of evidence. Headed by a lawyer with upwards of 30 years’ experience in criminal defense, one of our firm‘s strengths is utilizing the rules of evidence to protect our clients. Counsel cannot use criminal charges against a party in a civil case unless the Court grants a Wagg Order to do so.
