🏢 Victory for Condo Owners – MTCC 812 Fined Again! ⚖️

📢 Another win for condo owners’ rights! I had the honor of representing Tharani Holdings, a unit owner, in a case where Metropolitan Toronto Condominium Corporation No. 812 (MTCC 812) repeatedly violated the Condominium Act—and the Condominium Authority Tribunal (CAT) did not take it lightly.

🔹 First Violation (2019): MTCC 812 refused to provide essential records without a valid excuse and was fined $2,000. However, MTCC 812 refused to pay the penalty, forcing my client to take the matter to the Ontario Superior Court of Justice.
🔹 Superior Court Ruling: The court upheld CAT’s decision and not only ordered MTCC 812 to pay the $2,000 fine but also imposed additional costs exceeding $14,000 for their blatant disregard of the law.
🔹 Second Violation (2023): Despite these consequences, MTCC 812 again failed to provide crucial financial records, meeting minutes, and bank statements. The Tribunal responded by imposing the maximum penalty of $5,000—a clear warning that repeat offenders will face severe consequences.

💰 Additional Tribunal Orders:
✅ MTCC 812 must pay my client’s legal fees ($1,582) and application costs ($200).
✅ Board members must complete mandatory training to ensure compliance with the law.

🚨 Why This Case Matters?
This ruling reinforces a critical message: Condo boards must follow the law! Owners have the right to access records, and corporations that ignore legal obligations will face serious financial consequences. Transparency and accountability are non-negotiable.

The Two Paths to Mastery in Law: Experience vs. Knowledge

Years ago, I read a post by Scott McEachern that resonated deeply with me. He highlighted two ways to become a subject matter expert in the legal field:

1. Handle thousands of cases and learn through experience.

2. Read thousands of cases to enhance your knowledge rapidly.

One path takes years—and often a few grey hairs—while the other accelerates learning and growth (we still end up with gray hair)

A recent case against one of the largest insurance companies, Aviva, put this philosophy to the test. An intense eight-hour hearing on WSIA matters pushed my skills to new heights, proving that the habit of reading case law daily is a powerful investment in oneself.

This profession demands long hours and relentless dedication, but the reward of winning for clients makes it all worthwhile. While I now add wins and achievements to my practice, I’ve also endured humbling losses in court.

Instead of dwelling on them, we take them as learning opportunities—to analyze, adapt, and improve.

We often celebrate our victories, but losses teach us just as much, if not more. What have your toughest losses taught you? Let’s share and grow together.

Former LTB Adjudicator Files Lawsuit Alleging Toxic Workplace and Judicial Interference

Elan Shemtov, a former adjudicator with Ontario's Landlord and Tenant Board (LTB), has filed a $860,000 lawsuit against the Ontario government and his former supervisor, Sean Henry, citing wrongful dismissal, toxic workplace conditions, and interference with judicial independence.

Shemtov, appointed in early 2023 to help address the LTB’s significant backlog of over 46,000 cases, alleges a hostile environment where his decisions were excessively scrutinized. He claims Henry, the LTB vice-chair, undermined him with aggressive behavior and retaliatory actions after Shemtov raised concerns. According to Shemtov, Henry demanded an onerous review of his work and reduced his hours to near zero in May 2024, effectively breaching his contract and forcing his resignation.

The allegations also include an incident where Henry abruptly intervened in a virtual hearing, canceling proceedings in front of the involved parties—a move Shemtov described as unprecedented and a severe compromise of judicial independence.

The lawsuit sheds light on broader issues in Ontario’s tribunal system, including the lack of job security for adjudicators, limited initial terms, and inadequate protections against workplace conflicts. Advocacy groups like Tribunal Watch Ontario have called for reforms to strengthen the independence and working conditions of tribunal members.

The claims remain unproven in court, and Tribunals Ontario has declined to comment. The case underscores the challenges adjudicators face in navigating systemic shortcomings while upholding their judicial responsibilities.

When Integrity Leads the Way

In early January, I received a surprising call from a high-net-worth individual. While I knew his name, I had no personal connection with him, and his call left me stunned. He mentioned that a mutual acquaintance, his locksmith, had referred him to me for a legal matter. After a discussion, he retained me, though I quickly realized that this client came with a reputation for throwing tantrums and intimidating those around him.

During one instance, one of his staff nervously confided, "Sri, just do whatever he asks." But this client didn’t know he was dealing with someone equally resolute. When he tried dictating how I should handle his case, I stood firm and said, “If this is how you want it done, find someone else.” His wealth didn’t faze me. I hung up, assuming that was the end of it.

Two days later, he called back, softer this time, asking me to proceed as I saw fit. Though he tried influencing my approach several times, I didn’t waver.

In the end, we won his challenging case. This morning, he called with two of his team members on the line. His words? “Who says I don’t listen? See, I listened to Sriram, and I won my case.” Then, addressing me, he added, “I appreciate you standing your ground. I did try to tell you what to do, but you stuck to your approach and proved it was right. Thank you.”

Hearing that acknowledgment in front of his team was humbling, but it reaffirmed two key lessons for me:
1️⃣ When you know you’re right, stand firm, no matter the pressure.
2️⃣ As a professional, integrity and expertise should always outweigh the influence of money or status.

It’s not about the paycheck—it’s about leaving your signature on the work you do. Today, I am grateful for the opportunity to show that standing for what’s right always prevails.

Adding to this, I want to highlight one of my most inspiring moments in the profession. The photo below was taken in 2015 at the opening of my office, alongside Brian J. Lawrie, the founder of the paralegal profession. Brian single-handedly took on the Law Society of Ontario, advocating for the creation of the paralegal profession to provide clients with affordable access to justice. His perseverance and vision are the foundation of what allows us to serve clients today.

Behind the iconic Devil’s Advocate poster in the photo, Brian shared invaluable advice that has stayed with me over the years: to always fight for justice, to never compromise on integrity, and to approach every case with the client’s best interest at heart. These words resonate deeply with my experience in this recent case.
