The Canada Border Services Agency (CBSA) plays a central role in managing Canada’s borders, enforcing customs and immigration laws, and protecting national security.

For travellers, visitors, temporary residents, and newcomers, the CBSA may be one of the first Canadian authorities encountered at an airport, land border, or seaport. CBSA officers assess admissibility, examine documents and goods, and may take enforcement action when legal requirements are not met.
An interaction with the CBSA can have serious consequences for an immigration matter. Bill C-12 is now law, and it has left many people afraid that they waited too long to seek refugee protection in Canada.

You may have heard that, under the new rules, if you have been in Canada for more than one year, you are no longer eligible to make a refugee claim.

That is true, but that does not mean that you are out of options. If you are afraid of returning to your country of origin, there is still a legal process called a Pre-Removal Risk Assessment, or "PRRA" for short, through which you can still have the risk that you are facing properly assessed.

Do not disappear or resign yourself to living in the shadows without status.
Come forward, understand your options and get legal advice as early as possible.
Even if Bill C-12 affects you, your case may not be over. Talk to us first.

Meet Justin Heller, Partner at Lewis & Associates LLP ✨

Justin joined our firm as an articling student in August 2021 and has continued with the firm as a lawyer ever since. He successfully represents clients at the Immigration and Refugee Board, with appellate work at both the Refugee Appeal Division (RAD) and the Federal Court, and is experienced in Humanitarian and Compassionate (H&C) Applications and Pre-Removal Risk Assessments (PRRA).

While his practice is primarily focused on clients from Africa, Justin assists clients no matter their country of origin — and he will be happy to assist you with anything you require in the refugee process.

Preparing your refugee claim can feel overwhelming.
What should you include?
What do you leave out?
Oftentimes, so much has happened that people wonder how they can possibly explain it all without writing a novel. A refugee narrative should not be rushed or left for you to prepare alone.

Your lawyer should sit down with you, go through what happened carefully, ask the right follow-up questions and help identify the facts that matter most.
Your narrative should have a clear timeline. It should explain who harmed you, why you were targeted, what happened afterward, and why you cannot safely return.
Small details can become important later. Missing dates, unexplained gaps and unclear events can create problems at your hearing.

Your refugee claim is not based only on what you say.
A properly prepared claim usually includes documents that support your story.
This usually includes signed letters or sworn affidavits from people who witnessed important events or knew about them when they happened.
It may also include medical records from treatment after an attack, police reports, court documents, threatening messages, photographs and other records connected to your claim.

Where trauma, anxiety or memory problems could affect your testimony, a psychological assessment report can be critical to helping the decision-maker understand how those difficulties are impacting you.
A strong refugee claim is built through careful preparation and reliable supporting evidence.
