Visitor Visa Refusal Set Aside for Failing to Weigh Applicants' Ties to Their Home Country Against Family Ties in Canada
A recent Federal Court decision is an important reminder that having close family members in Canada does not, by itself, justify refusing a visitor visa.
In Kumar v. Canada (Citizenship and Immigration), 2026 FC 333, the Court found that the visa officer failed to properly consider the applicants' strong ties to their home country, including their employment, business interests, caregiving responsibilities, and previous travel history.
The Court held that officers must conduct a balanced assessment of an applicant's ties to both Canada and their home country before concluding that they may not leave Canada at the end of their authorized stay.
