TIP TUESDAY: What to expect during settlement negotiations in your personal injury case?
1. Timing of Negotiations - Settlement discussions typically begin after there is sufficient evidence to assess liability and damages.
2. The Role of Demand and Offer - Negotiations usually begin with a formal demand letter from the plaintiff’s counsel.
3. Expect Strategic Positioning - Both sides will approach negotiations strategically:
4. Evaluation of Damages - damages are influenced by precedent cases. More serious or permanent injuries generally attract higher compensation. Supporting documentation is essential in justifying these amounts.
5. The Importance of Evidence - Strong evidence significantly improves negotiating power.
6. Mediation and Settlement Conferences - In many cases, parties participate in formal settlement meetings such as mediation. These processes involve a neutral third party who helps facilitate discussions and resolution.
7. Risks of Proceeding to Trial - Settlement discussions often involve weighing the risks of going to trial.
8. Finalizing the Settlement - Once an agreement is reached, the terms are documented in a settlement agreement or release.

What Is the Dog Owners’ Liability Act and How Does It Protect Victims?
The Dog Owners Liability Act (“Act”) in Ontario is an important law that shapes the responsibilities of dog owners and provides clear protection for individuals who are injured by dogs. At its core, the Act is designed to protect the public. It recognizes that dogs, even those with calm and friendly temperaments, can behave unpredictably. Because of this, the law places responsibility on the owner rather than on the dog. This approach ensures that victims are not left without recourse simply because a dog has never shown aggression before. The Act focuses on the outcome of the incident rather than the intent of the owner or the past behaviour of the dog.
A major feature of the Act is the concept of strict liability. Under strict liability, a dog owner is responsible for injuries or damage caused by their dog regardless of whether they acted negligently. This means that a victim does not need to prove that the owner failed to supervise the dog or failed to take reasonable precautions.

TIP TUESDAY: Is “Optional” Insurance Coverage Really Optional?
A quick review now can save you major headaches later.
• Family Protection (OPCF 44R): If the at fault driver has little or no insurance, OPCF 44R lets you access your own higher liability limits. It is especially important for travel outside Ontario, where coverage can be much lower.
• Specified Perils: Covers listed events such as fire, theft or attempted theft, hail or rising water, earthquake, explosion, riot or civil disturbance, and if airplane parts start falling from the sky.
• Comprehensive Coverage: Covers non collision damage, including everything under specified perils plus vandalism.
• Collision or Upset: Pays for damage from hitting another object (another vehicle, the ground, or anything on the ground) or if your vehicle rolls over.
• All Perils: A full combination of collision and comprehensive. It also covers theft by someone who lives with you or works for you.

Understanding Myelopathy and Radiculopathy in Personal Injury Law

In personal injury claims, medical terminology often plays a decisive role in determining liability, causation, and damages. Two commonly misunderstood yet critically important conditions are myelopathy and radiculopathy. Although both involve the spine and nervous system, they differ significantly in their symptoms, and legal implications. Understanding these distinctions is essential when evaluating injury claims arising from motor vehicle accidents, workplace incidents, or degenerative conditions.

What Is Myelopathy?

Myelopathy refers to a pathological condition affecting the spinal cord itself. It is most commonly caused by compression of the spinal cord due to degenerative changes such as spinal stenosis, herniated discs, or ossification of ligaments. Trauma—such as that sustained in a car accident or fall—can also precipitate or exacerbate myelopathy.

What Is Radiculopathy?

Radiculopathy, by contrast, involves irritation or compression of a spinal nerve root as it exits the spinal column. This condition is typically caused by disc herniation, bone spurs, or acute trauma. Unlike myelopathy, radiculopathy does not involve the spinal cord itself but rather the peripheral nerves branching from it.

Who Can Bring a Fatal Accident or Wrongful Death Claim?
The death of a loved one caused by negligence or wrongdoing is a devastating experience, often compounded by financial uncertainty and unanswered legal questions. One of the most important questions in these cases is determining who has the legal right to bring a fatal accident or wrongful death claim. This question is governed by statute, and the answer varies depending on the jurisdiction. However, common legal principles provide a useful framework for understanding how these claims operate and who may be entitled to compensation.

Eligible Claimants
The following categories are typically recognized:

1. Spouses
This includes legally married spouses and, in many jurisdictions, common-law or domestic partners who can demonstrate a relationship of some permanence.

2. Children
Biological and legally adopted children and step-children of the deceased are commonly included as eligible claimants.

3. Parents
Parents and step-parents of the deceased may also have standing to bring a claim.

4. Other Dependants
• Siblings
• Grandparents
• Grandchildren
• Individuals who were financially dependent on the deceased

What if I can into an Accident Out-of-Province or Country?
Every year, many Ontario drivers venture outside of Ontario into other provinces and into the United States. In the process of these long road trips, potential motor vehicle collisions are inevitable. However, this can often be complex depending on which province the collision takes place. The insurance coverage available is dependant on all the facts of the collision.
Each province has its own rules and regulations with respect to collisions. Firstly, it is important to know what those rules are of the province you are travelling to before you drive into another province or to the United States.
JRJ LAW has assisted various claimants who have been in collisions across Canada and in the United States.

Common Injuries from Slip and Fall Incidents
Slip and fall accidents happen quickly and often without warning. A person might be walking through a store, traversing a sidewalk, heading down a stairwell when an unexpected event causes them to fall. What feels like a simple accident can lead to injuries that affect mobility, comfort, and daily functioning long after the moment of impact.
Ontario law requires property owners and occupiers to maintain safe conditions.

The Law Society of Ontario is aligning its competency requirements with the provinces of British Columbia, Manitoba, Nova Scotia, Prince Edward Island, Quebec and the Northwest Territories by implementing new Indigenous cultural training courses. These new courses are aimed and focused on enhancing the overall competence of licensees who are increasingly representing Indigenous clients and Indigenous legal issues.
