Late Rent Every Month? It May Be More Than Just a Problem. π βοΈ
Your tenant pays the rent β but itβs late. Every. Single. Month.
Many Ontario landlords assume thereβs nothing they can do because the tenant eventually catches up.
Thatβs not necessarily the case.
When late payment of rent becomes persistent, an N8 β Notice to End your Tenancy at the End of the Term may be an option.
Hereβs what landlords need to understand:
1οΈβ£ Persistent late payment is different from simply owing rent.
An N4 generally deals with rent that is currently unpaid. An N8 can address a pattern of repeatedly paying rent late.
2οΈβ£ Documentation is critical.
If youβre going to allege persistent late payment, you need to be able to demonstrate the pattern. Keep accurate records showing when rent was due and when it was actually paid.
3οΈβ£ Donβt normalize late payments.
When a tenant pays late month after month, landlords sometimes fall into the trap of accepting it as the new normal.
Meanwhile, the mortgage, property taxes, condo fees, insurance and other expenses donβt wait because the tenantβs rent is late.
4οΈβ£ An N8 doesnβt automatically mean eviction.
The notice is part of a legal process. If the matter proceeds to the Landlord and Tenant Board, the landlord still needs to establish their case, and the Board ultimately determines the outcome.
The important thing is recognizing when an occasional late payment has turned into a persistent pattern.
