James R. Olchowy was called to the Ontario Bar in 2001. He is a sole practitioner with nineteen years of experience in litigation. His current practice focuses upon family law, employment law, and human rights.
In 1999-2000, prior to becoming a lawyer, James served with distinction as a Law Clerk to the Chief Justice of the Superior Court of Justice and the Justices of the Ontario Superior Court of Justice in Toronto. After working for several years as an associate lawyer at several highly regarded law firms, James opened his own law firm in 2011 in the heart of Etobicoke. His office is conveniently located in Bloor Islington Place, in close proximity to the Islington subway stop on the Bloor-Danforth line. In his work as a family law practitioner, James is engaged in all aspects of claims arising from separation and divorce, including the litigation, mediation and/or arbitration of disputes concerning child-related and property-related issues. He is also frequently involved in the negotiation and drafting of cohabitation agreements, marriage contracts (or prenuptial agreements), and separation agreements. In his work as an employment law practitioner, James is engaged in all aspects of claims resulting from the creation or termination of employment relationships. He frequently reviews severance packages and advises dismissed employees of their rights. He also reviews or drafts employment contracts on behalf of both employees and employers, and represents employees or employers in wrongful dismissal litigation. James also handles human rights claims, particularly those that arise in cases involving employment law or wrongful dismissal. James is thoroughly familiar with all forms of dispute resolution, including mediation, arbitration and litigation, and realizes that, while many cases can be settled outside court through skillful and persuasive negotiation, other cases require court attendances, motions and sometimes even a full trial before a dispute can be finally and comprehensively resolved. In representing his clients in disputes, James integrates a pragmatic style alert to the possibility of achieving a reasonable and economical settlement, with skillful courtroom advocacy that interweaves a detailed understanding of the facts of each case with a persuasive command of the applicable law.
James believes in having lots of direct contact with his clients. Clients benefit from knowing that James is easily reachable and always personally handling their files. James has a B.A. in English from the University of Alberta, an M.A. in English from the University of Victoria, a Ph.D in English from Dalhousie University, an LL.B from Queen's University, and an LL.M in Civil Litigation and Dispute Resolution from Osgoode Hall Law School. In keeping with his interdisciplinary background, he has published academic articles on evidence law and storytelling, on the interrelationship between literature and law, on alternative dispute resolution, and on constitutional law. His professional background includes teaching stints as an English Professor at various universities in Atlantic Canada, but also teaching assignments at two of Ontario's most prestigious law schools, Queen's University and Osgoode Hall Law School.
