Another OTLA conference in the books! As always, it’s great to have the team together to learn and exchange tips and strategies that keep our skills sharp when fighting the insurance companies to secure the best results for our clients.

This time was also extra special as our Partner, Michael Giordano, was honoured with an award recognizing his dedication to OTLA over the past decade serving as a Board member and member of the Executive Committee over his past two terms. While he has reached his maximum consecutive term on the Board, he will remain involved in Committee work.

Our Senior Associate, Antonia Hristova, remains on the OTLA Board and will continue with her valuable contributions to the Association.

We’re all proud members of OTLA which is an Association that seeks justice for accident victims all across Ontario.

We had a great time hosting York University’s Latin American Legal Association ‘LALA’ last week! This was a first for AvaGio although we’ve previously hosted CLE Roundtables to mentor junior lawyers in the industry!!

There was a tour, there was some dialogue and questions were answered! We had a great time and happy to put this kind of an event on repeat! It’s always great to have interested students come by and give direction and guidance for prospective lawyers! We’re a diverse group with various backgrounds and experiences and we’re all happy to share from this wealth of information and make the journey easier for the next individual interested in a legal career.

Huge thanks goes to Braden who took on this meet and greet and made all the students feel welcome!

After the insurer denied key accident benefits and care, the matter proceeded to a contested hearing. Michael Giordano and Antonia Hristova appeared for the applicant and brought home a significant win, securing a catastrophic impairment determination for our client as well as much needed attendant care benefits.

This finding is critical as it unlocks access to up to $1 million in accident benefits for treatment, rehabilitation, and care for individuals who have suffered the most serious injuries.

The insurer had denied entitlement to key benefits, forcing the client to pursue the matter through litigation.

The Tribunal accepted our arguments and expert evidence and found that the client suffered marked impairment across all four areas of daily functioning.

This is yet another case that highlights the real impact of our work. When insurers deny the care people need after life-altering injuries, we’re up for the fight to ensure our clients receive the support, treatment, and dignity they deserve.

Ending the week on a high note! Motion win for our partner, Aline Avanessy. The insurance company was trying to force our client to an examination as a legal strategy. While there may be entitlement, and it would have been ‘easier’ to comply, we refused to concede and fought the motion instead thankfully with a positive outcome.

This year’s celebration hit a bit different in a BIG and WONDERFUL way! We hit a massive milestone of 10 years and had plenty to be cheerful about with Michael’s trial win, precedent setting cost decision, numerous motions won, LAT hearings and appeals! The speech was a bit longer this year as we went over the various highlights of 2025. What a way to go into 2026!!

Yesterday the AvaGio fam had the good fortune of getting together while supporting a great cause! Really, is there anything better during this time of year?!

We’re missing a couple people but the rest of us enjoyed a meal and some quality time away from the office and everyone received a special toque to spread awareness and support

Headsup Concussion Advocacy Network is an incredible group which donates part of their brand sales to the Canadian Concussion Centre to support an expansion of social programming for people with lived experiences and advocate on behalf of everyone who has sustained a brain injury/concussion. They also raise awareness and provide education programs which can be used for training and research programming.

Countless of our clients come to us with brain injuries and while the community funding and resources are there, we can always do better and push for more education and awareness which is why this year we were proud to support HeadsUp in their endeavours! Feels good to do good and yes, it helps to look good in our new toques while doing it! 🙌🏼

At Avagio Law, our advocacy doesn’t stop in the courtroom — it continues at Queen’s Park to protect the rights of accident victims and ensure fair access to justice across Ontario.

Last week, our Senior Associate Antonia Hristova joined colleagues from across the province for the Ontario Trial Lawyers Association’s annual Lobby Day, where over 42 meetings were held with MPPs to advance key issues affecting injured Ontarians.

Discussions focused on the upcoming July 1, 2026 changes to the Statutory Accident Benefits Schedule, including the move to make Income Replacement Benefits optional, the need for a public education campaign so drivers understand their coverage choices, and important amendments to the Rules of Civil Procedure.

The day concluded with remarks from The Honourable Doug Downey, Attorney General of Ontario. Antonia was proud to contribute to the drafting of OTLA’s submissions during the government’s consultation process — advocacy that The Honourable Doug Downey, Attorney General of Ontario, recognized as instrumental in shaping the forthcoming report of recommendations on the sweeping Rules changes ahead.

OTLA’s Fall 2025 Conference!

The AvaGio team had a great time attending the even yesterday, and in Michael Giordano’s case, presenting to our colleagues in the industry.

Mike’s topic is an important one. As of January 1, 2020 the monetary limit for the simplified procedure increased from $100,000 to $200,000 making it a great way to push some claims through litigation at a faster pace and with less costs.

It’s always nice to get out of the office, continue our legal education and meet with like minded lawyers to exchange ideas and information.

Who knows, maybe for the Spring Conference Mike will present on his incredible jury trial victory and precedent setting costs decision!! Stay tuned!!

Our Partner, Mike Giordano, was back in Court again with another successful result and received significant costs awarded to our client.

This was the second appearance at a contested Motion to dismiss a duplicative action involving our client on the basis that it was an abuse of process. The Court found in favour of our client. 👏

When faced with unreasonable parties or positions, we don’t back down. We stand with our clients and fight for what is right.
