New Decision: This was a hard-fought summary judgment motion that our client was successful on. Ari Krajden and Davis Bowers successfully argued that the insured’s willful misrepresentation could not be corrected after the fact and that relief from forfeiture was not appropriate. Ari and Davis also argued that a misrepresentation on the reporting of the claim need not be referenced on the application for insurance. This case will provide clarity on future claims where a clear willful misrepresentation has been made.

Ari Krajden and Davis Bowers of our firm had the privilege of arguing a case at the Ontario Court of Appeal this week!

We are pleased to announce a recent success for our firm at the LAT on a preliminary issue motion, where we were successful in having a matter dismissed as the doctrine of Res Judicata applied.

In this case, the Applicant had previously brought a LAT application in which they were found to be in the MIG. As part of that original decision, a section 25 Psychological Assessment Report was excluded from evidence as it had not been produced to the Respondent within the applicable deadlines. The Applicant filed for reconsideration, which was dismissed.

The Applicant then filed a brand new LAT application seeking to dispute entitlement to 6 additional treatment plans which were not subject to the initial decision. The Respondent raised the preliminary issue motion in that new application to argue the new application ought to be barred by the doctrine of Res Judicata as the Applicant had already been found to be MIG, and there was no fresh new evidence that was not previously unavailable. The Adjudicator agreed with the Respondent. In doing so they considered that the new treatment plans and the previously excluded psychological report were not fresh new evidence. As such the entire application was barred from proceeding to substantive issue hearing.
