Can I withhold rent because my landlord isn't properly maintaining my building or unit?
No. If you withhold rent, the landlord can give you a notice of termination for non-payment of rent and then file an application to evict you.

Can a landlord ask for a deposit for keys?
Yes, but only if:

the deposit is refundable, and
the amount of the deposit is not more than the expected cost of replacing the key(s) if they are not returned to the landlord.
The landlord must give the deposit back when the tenant turns in their key(s) at the end of their tenancy.

What can I do if my landlord does not turn on the heat?
If the landlord is responsible for providing heat and the landlord does not keep the unit heated to at least to 20 degrees Celsius from September 1 to June 15, you can call your local municipal government and ask to have the property standards by-law enforced or, if there are no property standards by-laws, then to have the provincial maintenance standards enforced. By not providing a vital service, the landlord may be committing an offence.

Second-hand smoke (cannabis or to***co) from a neighbour is bothering me. What can I do?
Your neighbours can smoke in their private homes, unless they signed a lease or there are condominium bylaws that say they can't. However, if second-hand smoke (to***co or ma*****na) from another unit is interfering with the reasonable enjoyment of your home, speak to your landlord.

If your landlord cannot resolve this issue, you can apply to the LTB using a T2: Application about Tenant Rights. You can file this application online through the Tribunals Ontario Portal. You will be asked to show how the other tenant's behaviour is clearly interfering with your reasonable enjoyment. The LTB determines each application on a case-by-case basis.

Pets and Smoking
Can a landlord refuse to rent to a person who has a pet?
Yes. A landlord can refuse to rent to a person who has a pet. A service animal is not considered a pet.

Can a landlord evict a tenant for having a pet?
A tenancy agreement cannot forbid a tenant from having a pet. And once there is a tenancy agreement, a landlord cannot evict the tenant simply for having a pet. This is true even if they agreed that the tenant would not have a pet.

However, there are some cases when the landlord can apply to the LTB to evict a tenant who has a pet. These are some common examples:

the pet is making too much noise, damaging the unit or causing other tenants to have allergic reactions;
the breed or species is inherently dangerous (e.g. a tenant's pit bull could be considered "inherently dangerous" even if it hasn't bitten anyone);
the rules of the condominium corporation does not allow pets like the one tenant has.
