Limitation Periods Aren’t One‑Size‑Fits‑All. Here’s What Most People Don’t Know:
The standard two‑year limitation period in Ontario applies to adults, but there are major exceptions that can completely change the timeline of a legal claim.
For minors, the clock doesn’t even start until they turn 18. A child injured at age 7 has until age 20 to sue.
For mentally incapable persons, the law recognizes that they cannot understand or pursue a claim, meaning the limitation period is paused entirely.
Some claims, like those involving sexual or physical abuse, have no limitation period at all.
And beyond limitation periods, certain cases, especially slip and falls on snow or ice, require 60‑day notice before a lawsuit can even begin.
