How to become a Refugee in Canada

Canada has two refugee protection programs:

• In-Canada Asylum Program – for people making refugee protection claims from within Canada.
• Refugee and Humanitarian Resettlement Program – for people who need protection from outside Canada.

The In-Canada Asylum Program
People arriving at a Canadian point of entry or already in Canada can apply for refugee protection by making a refugee claim to the Immigration and Refugee Board of Canada (IRB). The IRB will hear a case and decide according to two protection categories.

• A Convention Refugee has a well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, being outside of their country of nationality and being unable or unwilling to return.

• A person in need of protection faces the danger of torture, risk to their life or risk of cruel and unusual treatment or punishment if they return to their home country.

The Refugee and Humanitarian Resettlement Program

The Refugee Resettlement Program helps refugees outside of Canada and their country of origin who need protection.
People must be referred by the United Nations Refugee Agency (UNHCR), a designated referral organization, or a private sponsorship group; they may need a refugee status document.

Studying in Canada with Children or Dependents 🇨🇦

➡️ Any parent applying to study in Canada is welcome to include dependent children on their study permit application.

➡️ A dependent child is any child under 22, or over 22 but dependent on parents because of a mental or physical condition.

➡️ The child is issued a visa authorizing their stay in Canada for the same duration as the parent’s permit.

➡️ Once inside Canada, all children 18 years and younger are allowed to study at Canadian elementary and secondary schools.

➡️ Most Canadian schools for children are public and free! Canada is a global leader in quality of education, so children will be receiving the high-quality learning they deserve.

➡️ Depending on a person’s study permit application, including children and spouses may impact the immigration officer’s decision on whether to approve or reject the study permit.

➡️ If you are concerned about including your family members on your study permit application, you should consult with a legal representative.

International Students can change their College or University after landing in Canada or in between their studies.

You can change your DLI while your study visa application is in progress, once it is approved (but you are still outside Canada), OR after landing in Canada and getting your study permit at the airport.
You can change your DLI prior to starting your classes for the intake you took admission in OR even after completing the first semester.

International students usually have one hundred and fifty days from the time they stop attending classes at their present college or university to enroll in a course at another DLI.

How to change the DLI

Whenever you make a decision to change your post-secondary institution, you are required to inform IRCC.
However, there is no need for you to make any adjustments to your study permit requirements.

Can I switch my DLI while in Canada?

Yes, international students in Canada can change their DLI or program, but they need to follow the proper process of informing IRCC about the change.

Failing to do so may result in removal from Canada as well as complexities in applying for a work permit after graduation because you did not comply with your study permit conditions.
