📌 Is Contract Work in Canada Considered Employment or Self-Employment for PR under CEC?

As an RCIC, one of the most common questions I get is:

“Mr. Narendra, I’m working as a contractor in Canada and I get paid through my corporation. Can this experience be used for Canadian PR under the CEC stream?”
🛑 Short answer: It depends — but in most cases, it is considered self-employment, which does NOT qualify for the Canadian Experience Class (CEC) program (except for a limited group like certain physicians).
According to IRCC guidelines, the nature of your working relationship matters more than whether you're incorporated or receiving invoices. IRCC looks at specific factors, including:

🔹 Control: Do you decide how, when, and where to work?
🔹 Tools: Do you use your own tools and equipment?
🔹 Delegation: Can you subcontract or must you personally do the work?
🔹 Risk: Do you bear financial risk and make business decisions affecting profit/loss?

Temporary Resident Visa Refusals – Can You Request a Reconsideration?

As an RCIC, I often come across temporary resident applications that are refused without a detailed explanation. It’s important to understand that IRCC officers are not obligated to provide an exact reason for refusal beyond the standard refusal letter.

However, there is a possible remedy — Reconsideration.

💡 What is Reconsideration?
If you believe the decision was made based on an error of fact or law, and you had already submitted all relevant documents either with the application or through a webform before the decision, you may request the officer to reconsider.

✅ Why consider this option?

No application fee
Faster than reapplying
Gives you a chance to correct an officer’s error without restarting the entire process

⚠️ Note: Reconsideration is not a right — it's a request. The officer is not obligated to respond or reverse the decision. It only works if there’s clear evidence of a mistake in the original decision.

🎯 PR After a 2-Year Diploma in Canada: What Are Your Options?

As an RCIC, I often get messages like this:

"Sir, I came to Canada for a 2-year diploma after high school. I have no work experience from back home. I'm currently working as a restaurant or security supervisor. What are my chances for PR?"

👉 Without a bachelor’s degree, foreign experience, CLB 9, French, or a sibling in Canada, your CRS will likely max out around 473 — not enough for an Express Entry ITA under current trends.

But there are still pathways. Here are your options:

🔹 1. Gain 1 Year of Foreign Work Experience
If you return to your home country and gain 1 year of skilled work experience, and combine it with CLB 9, you can gain 40+ CRS points. That could push your score over 500 and make you a strong Express Entry candidate.

✅ Tip: Ensure you return to Canada within 2 years to retain CEC eligibility (you need 1 year of Canadian experience within the last 3 years).

🔹 2. Learn French (CLB 7)
Achieving CLB 7 in French opens you up to category-based draws and can add 25–50 extra CRS points. However, this is a long-term strategy—achieving CLB 7 may take 2–3 years if starting from scratch.

🔹 3. Be in a Category-Based Occupation
If you're in trades, healthcare, STEM, or transport, you're eligible for category-based draws with lower cut-offs. These occupations are currently prioritized by IRCC.

🔹 4. Explore PNP Options
Many Provincial Nominee Programs (PNPs) target international graduates with job offers. Some provinces have special streams for graduates, especially if you studied and work in that province.

🔹 5. RNIP – Employer-Driven PR Support
The Rural and Northern Immigration Pilot (RNIP) is ideal if you're working in a rural community and your employer is willing to support you. Lower CRS and community endorsement are advantages here.

🎓 A diploma is a good foundation, but you need a strategy to build on it.
Focus on CLB 9, gaining foreign experience, or identifying a PNP or category-based draw stream.

As a Regulated Canadian Immigration Consultant (RCIC), I often get asked:
"Can I add work experience to my Express Entry profile that I didn’t mention in my previous study or work permit application?"

My answer is — Always NO, unless you have a clear, honest explanation.

Recently, I came across a case (not my client) where an applicant added new work experience in their PR application that wasn’t disclosed earlier. The result?
🔴 Application rejected
⚠️ Facing a possible 5-year ban from Canada for misrepresentation.

This is a serious reminder that inconsistencies or omissions can have devastating consequences. Even if the intention wasn’t to mislead, failing to disclose or explain prior information can be viewed as misrepresentation by IRCC.

Important Alert for Immigration Applicants

Recently, IRCC issued a refusal letter to an applicant citing use of an undeclared and unauthorized representative. The decision highlights a critical and growing trend — IRCC is actively using AI tools to detect patterns in applications that suggest the involvement of unauthorized third parties.

📌 According to section 16(1) of the Immigration and Refugee Protection Act, applicants must answer all questions truthfully and disclose all relevant evidence. Failing to disclose the use of a representative — especially an unauthorized one — is considered a material misrepresentation.

⚠️ Consequences?
If it’s found that your application was prepared by an unauthorized representative and you failed to disclose it, you may be barred from entering Canada for 5 years under section 40(2)(a).

Do not risk your future in Canada by working with unauthorized representatives.

If you've recently received your eCOPR (electronic Confirmation of Permanent Residence), congratulations on reaching this major milestone! 🎉 However, before taking your next steps, it's essential to review your eCOPR carefully for accuracy. Pay close attention to your name, date of birth, country of birth, marital status, and document number. Even the smallest error can lead to complications in your settlement process. If you notice any incorrect information, you must immediately submit an Application to Amend your eCOPR through the IRCC portal.

One of the most critical post-eCOPR tasks is updating your Social Insurance Number (SIN) at a Service Canada office. But here's the catch—if the information on your eCOPR doesn't exactly match your passport or identity documents, Service Canada will reject your SIN application due to inconsistencies. This mismatch can delay your ability to legally work in Canada, access government benefits, file taxes, or even open a bank account. In some cases, errors left uncorrected may impact your eligibility for citizenship in the future or complicate travel, sponsorship, or renewals. As an RCIC, I strongly advise addressing these issues promptly to avoid unnecessary delays and stress down the line.
