A significant procedural victory for HSH!

HSH Partner Kaitlyn MacDonell and Associate Luis Palacios recently secured a favourable decision in Blaney v. Werstine et al., 2026 ONSC 4880, successfully opposing a motion to divide a personal injury jury trial into separate proceedings for liability and damages.

The Ontario Superior Court of Justice dismissed the motion, reinforcing that the possibility of saving time or encouraging settlement is not enough to justify splitting a trial. The Court also recognized the potential prejudice to plaintiffs, including repeated testimony and the risk of inconsistent findings.

This decision provides important guidance on Ontario's updated rules governing bifurcation and highlights the importance of ensuring fairness throughout the litigation process.

A new report from Global Action on Gun Violence examines the cross-border trafficking of fi****ms from the United States into Canada and the role that legal action may play in addressing the gun trafficking pipeline.
