Kim Spencer McPhee is prosecuting a class action against Schering-Plough Corporation, Schering-Plough Canada Inc., Merck & Co., Inc. seeking damages for negligence, breach of implied warranty, and failure to warn as a result of the Defendants' development, manufacture and sale of NuvaRing. oes not need to be taken every day in order to receive a full month of pregnancy protection. The Claim alleges that NuvaRing causes numerous health risks, including the risk of blood clots, deep vein thrombosis, pulmonary embolism, stroke, and heart attack. The Claim also alleges that NuvaRing releases hormones in greater amounts than represented, thereby increasing the health risks associated with the use of NuvaRing. The Claim alleges that the Defendants knew of the health risks associated with the use of NuvaRing but failed to warn Health Canada, doctors and patients of those risks. The Claim seeks damages on behalf of all persons in Canada who were prescribed and who used NuvaRing and their family members.
