No one wants their business to fail, but sometimes this happens despite your best efforts. If your business fails, it may have a serious impact on your ability to obtain permanent residence status, depending on the specific terms of the program you apply through.

The Start-up Visa Program (SUV) is a direct pathway to permanent residence, and if approved is not conditional on the success of the business. Permanent residents under this program retain their status even if the business fails, provided they continue to meet the general obligations of permanent residents.

However, for the Provincial Nominee Program (PNP) for entrepreneurs, the situation can be different. Most PNPs first issue a temporary work permit to allow the entrepreneur to start and operate their business in Canada. Permanent residence is granted only after the business has met certain conditions outlined in the provincial nomination, such as investment thresholds and job creation. If the business fails to meet these requirements during the specified period, it will affect the entrepreneur’s eligibility for permanent residence.
