Successful candidates will possess strong advocacy and communication skills, the ability to work independently, carry their own client files, and assist senior counsel as required. Most importantly the candidate is a team player and focused on providing cost efficient solutions for our clients.

A minimum three years’ experience as a family lawyer in Ontario is required.

Responsibilities Include:

- Independent and effective management of family law matters

- Have excellent drafting skills and communication skills including research, drafting, oral advocacy and client management skills

- Demonstrate strong attention to detail and organizational skills

- Proactive communication with clients, develop and maintain a positive and trusting relationships throughout the duration of each matter

- Keeping current with Ontario family laws, statutes, rules and regulations

- Meeting annual billable target of 1,200 hours

- Offer flexible arrangements

Qualifications:

- JD/LLB degree from an accredited Canadian institution or an equivalent degree with NCA accreditation

- Must be licensed with the Law Society of Ontario and in good standing

- 3+ Years of experience as a lawyer in the practice of family law required

- Familiarity and experience with the practice of docketing

In S. v. A., 2022 ONSC 55 (CanLII), the parties spent approximately $1.7 million in litigating their family law dispute. After a lengthy 9-week trial, the Mother was ordered to pay costs of over $677,000 to the Father due to what that the Court found to be her “WIN AT ALL COSTS” approach. The Court reiterated that family law litigants are to be held responsible for their litigation positions and the financial consequences of those decisions.

The court held that the mother’s motion for an interim increase in child support was to proceed on an uncontested basis, as the father failed to comply with a court order requiring him to file an answer and updated financial information.

The court made an interim order increasing the father’s child support obligation from $1650 per month, provided in a 2016 interim order, to $3,282 per month, effective August 1, 2021. This is due to a material change in circumstances, including the birth of a third child, the mother’s loss of her job, and the father’s attempt to withdraw from the legal proceedings. The court imputed income to the father based on his last known gross annual income of $190,000 for 2018.

In N.S. v. R.M., the Ontario Superior Court dismissed Father’s appeal of an OCJ order that permitted the mother to relocate with the parties' children from Orleans, Ontario to Montreal, Quebec.

The evidence supports the trial judge’s determination that the mother’s financial and employment circumstances would improve if she moves to Montreal, where she could work for her mother’s real estate business.

In determining the move, the judge relied on the following factors: the close proximity between Orleans and Montreal, the possibility of the Father to have meaningful time with the children, the real estate management job in Montreal which improves the Mother’s flexible work schedule and the social and economic well-being of the mother and children.

In Mahtani v. Mistry, The Ontario Court of Appeal dismissed the Husband’s appeal of an order for spousal and child support and equalization of property given to the wife.

The Husband did not question the judge’s determination that he was intentionally underemployed. He also did not challenge the determination that he intentionally diverted business from his corporation to another company incorporated by his family two weeks after the parties’ separation.

The trial judge imputed income to the husband and found that he was deliberately underemployed. It was open to the trial judge to accept the opinion of the wife's expert that additional income should be imputed to the husband. There was no basis to interfere with the trial judge's determination of the value of the husband's interest in his business, VAMS Canada Inc. As such, no error warranted appellate intervention.
