UNDERSTANDING TR to PR

Today, Immigration, Refugees and Citizenship Canada (IRCC) announced progress on a new measure often viewed as an update to the TR-to-PR pathway. Officially known as the One-time In-Canada Workers Initiative, the program’s name is important, but the concept is familiar - certain temporary residents already living and working in Canada may have a faster route to permanent residence.

PR applicants should review this announcement carefully. IRCC has not introduced a new public TR-to-PR pathway, nor has it launched a new portal, or intake cap. Instead, the department indicates it will expedite certain permanent residence applications that are already in process.

SPOUSAL SPONSORSHIP - COMMON MYTHS CONTINUED....

Myth 5: Arranged or love marriages are treated differently.

Fact:
IRCC does not distinguish between love marriages and arranged marriages. What matters is whether the relationship is genuine and not entered into primarily for immigration purposes. Arranged marriages can be approved when properly documented.

Myth 6: Getting married in Canada guarantees approval.

Fact:
A marriage certificate alone does not guarantee approval. IRCC assesses the entire relationship history, cohabitation, communication, financial interdependence, and social recognition.

Myth 7: Common-law relationships are harder to prove than marriages.

Fact:
Common-law relationships are not harder, but they require clear evidence of at least 12 months of continuous cohabitation, such as joint leases, bills, and correspondence.

Myth 8: Having children together guarantees approval.

Fact:
Children are a strong indicator of a genuine relationship, but they do not guarantee approval on their own.

SPOUSAL SPONSORSHIP - COMMON MYTHS

Myth 1: You must meet a minimum income requirement to sponsor your spouse.

Fact:
For spousal, common-law, or conjugal partner sponsorship, there is no minimum income requirement, unless the sponsored spouse has dependent children who have their own dependent children.

Myth 2: Age gaps or short courtships automatically lead to refusal.

Fact:
Large age differences or brief relationships may receive closer scrutiny, but they do not automatically result in refusal.

Myth 3: Living apart means your relationship is not genuine.

Fact:
Many couples live apart due to immigration, work, or family obligations. IRCC recognizes this and focuses on ongoing communication, visits, and intent to live together permanently.

Myth 4: The sponsored spouse cannot work while their application is in process.

Fact:
Applicants inside Canada may be eligible for an open work permit while their application is being processed.

Spousal Sponsorship Questions -Frequently Asked by Our Clients:

Q. How long does the sponsorship process take?
A. Processing times vary, but most cases take 6–12 months depending on the applicant’s country of residence and the completeness of the application.

Q. Can my spouse come to Canada while the application is in process?
A. Yes. In many cases, your spouse may apply for a temporary resident visa or an open work permit while waiting for the sponsorship decision.

Q. What documents do we need to prove our relationship is genuine?
A. Common documents include photos together, communication records, joint finances, proof of cohabitation, travel history, and affidavits from friends/family.

Q. Do we need to be living together to qualify?
A. Not always. Married couples do not need to be living together, but you must show an ongoing, genuine relationship.

Q. What if my spouse’s passport or documents are hard to obtain?
A. Special circumstances can be addressed with IRCC through detailed explanations and supporting evidence, which we help prepare professionally.

Q. Can I sponsor my spouse if I previously sponsored someone else?
A. You may still be eligible, but there are certain conditions and waiting periods. We can assess this during a consultation.

Q. What are the financial requirements to sponsor my spouse?
A. There is no minimum income requirement for spousal sponsorship, but you must show you can support your partner’s basic needs.

Q. What happens if IRCC requests an interview?
A. We prepare our clients thoroughly by reviewing relationship details, documents, and interview expectations.

Q. How can your consultancy help us?

A. We provide:

- Personalized assessment of eligibility

- Complete application preparation

- Guidance on relationship evidence

- Ongoing communication with IRCC
