CAN YOU SPONSOR YOUR SPOUSE OR FAMILY MEMBER IF YOU HAVE A CRIMINAL RECORD?

Yes, possibly - but it depends on the circumstances.

One important distinction is whether you were charged with an offence or convicted of one.

🔹 Charged but NOT convicted?
Being charged with a criminal offence does not automatically mean you are barred from sponsoring a family member.

What happened with the charge - for example, whether you were acquitted or the charge was withdrawn or dismissed - can be important.

🔹 Convicted of an offence?
Certain criminal convictions can make a Canadian citizen or permanent resident ineligible to sponsor a family member, particularly convictions involving certain violent or sexual offences or offences involving a family member.

⚠️ Don't assume that a criminal charge or conviction automatically means you cannot sponsor someone.

Every case should be assessed based on the specific criminal history and the applicable immigration rules.

UNDERSTANDING TR to PR

Today, Immigration, Refugees and Citizenship Canada (IRCC) announced progress on a new measure often viewed as an update to the TR-to-PR pathway. Officially known as the One-time In-Canada Workers Initiative, the program’s name is important, but the concept is familiar - certain temporary residents already living and working in Canada may have a faster route to permanent residence.

PR applicants should review this announcement carefully. IRCC has not introduced a new public TR-to-PR pathway, nor has it launched a new portal, or intake cap. Instead, the department indicates it will expedite certain permanent residence applications that are already in process.
