After a summer away from the Ontario Court of Appeal, the lawyers at Lockyer Zaduk Zeeh will be there frequently throughout September and October for the following appeals:

September 8 – R. v. J.O.: Jeffery Couse and Victoria Strugurescu will address an s. 11(b) appeal arising from a decision of the Toronto Superior Court of Justice.

September 11 – R. v. Owusu: Elek Reitsma will argue a sentence appeal involving fi****ms and controlled substances arising from the Toronto Superior Court of Justice.

September 23 – R. v. Mustard: James Lockyer and Chelsea Latremouille will argue a conviction appeal in a second-degree murder case from Toronto.

September 29 – R. v. Gaskin: James Lockyer will argue an appeal involving a potential miscarriage of justice.

October 1 – R. v. Z.A.: Jeffery Couse will argue a conviction appeal in a sexual assault matter from London, Ontario.

October 13–14 – R. v. J.A.: James Lockyer will join Mindy Caterina to argue a conviction and sentence appeal involving sexual assault and other charges arising from Toronto.

October 23 – R. v. Hay: James Lockyer and Simon Kim will argue a conviction and sentence appeal involving two counts of first-degree murder arising from Newmarket.

It will be a busy fall at the Court of Appeal, with our lawyers appearing on appeals involving unreasonable delay, sentencing, sexual assault, fi****ms, homicide, and potential miscarriages of justice.

To start the week, Arooba Shakeel's client was acquitted on all counts of assault and sexual assault following a domestic-related trial in the Collingwood Ontario Court of Justice.

This was a highly contested trial that required careful consideration of complex tactical and evidentiary issues, including ss. 276 and 278 applications and the introduction of text messages and recordings.

Shawn J. Lallman's client was acquitted of possession for the purpose of trafficking in the London Ontario Court of Justice.

After successfully defending the “for the purpose of trafficking” element of the charge, the client was found guilty only of simple possession. The Crown then appropriately stayed that charge.

As a result, the client was able to walk out of the prisoner’s box.

A nice way to conclude a good week in the St. Catharines.

After establishing a Charter breach, but with the judge declining to exclude the evidence under s. 24(2), Linnea Kornhauser's client was acquitted in the Ontario Court of Justice of driving while prohibited and possession for the purpose of trafficking.
