🌐 Lerom Law assisted an Ontario business in successfully obtaining a positive LMIA under the Global Talent Stream Category B to retain a temporary foreign worker. The TFW applied for a closed work permit based on this LMIA, allowing them to continue working in Canada for three more years. This also facilitated their transition to becoming a permanent resident through Express Entry, as the TFW received additional points for a qualified, valid job offer. 📋

📚 Understanding Canadian immigration laws 🍁 can be tough. Did you know all foreign nationals allowed to enter Canada 🇨🇦 are granted temporary resident status under the Immigration and Refugee Protection Act (IRPA)? They can even work or study with or without a permit! But remember, all must leave at the end of their stay unless an extension is applied for. Dive into the complexities with us.

The policy document discusses the regulations related to the status of temporary residents in Canada according to the Immigration and Refugee Protection Act (IRPA) and the Immigration and Refugee Protection Regulations (IRPR).

Under IRPA, all foreign nationals allowed to enter Canada are granted temporary resident status. These temporary residents may also be permitted to work or study, either without a permit or with a specifically issued permit.

The regulations stipulate that all temporary residents must leave Canada at the end of their authorized stay. However, there are provisions in place for temporary residents to apply for an extension of their authorized stay. If a temporary resident applies for an extension before their current authorization expires, their temporary resident status is legally extended until a decision is made on their application.

An important distinction is made for holders of a temporary resident permit (TRP). While they are considered temporary residents, they cannot retain their status during the processing of a new TRP request because this process is considered a request for a subsequent TRP under a different section of the regulations, not a renewal. Therefore, they do not meet the conditions to extend their temporary resident status.
