While I am a great advocate for the benefits of mediation, one important pitfall to avoid is mediation fatigue. It not only occurs in mediation, but it is of especial concern in mediation because a wily opponent will take advantage of it to the weary bargainer's detriment. The end of a long day is not always the best time to make decisions that will have impact on parties that may last a lifetime. Take your time.

What are the two main types of mediators, and what is the difference between them? The two main types of mediators are evaluative and facilitative. The former guides parties to a mediated solution, while the latter allows the parties to achieve resolution of the conflict through a more nuanced approach. My preference is to use a hybrid approach, combining aspects of both!

I firmly believe that mediation is the best way to resolve most disputes, however it does take a more reasoned approach by all in order for it to succeed. The following is a short list of the actions counsel can take to foil a mediation: (1) Take an overly aggressive stance that alienates the other party, their counsel and the mediator; (2) Fail to prepare for the mediation thereby rendering it useless and a waste of everyone's time; and (3) Make unreasonable demands and/or refuse to budge from a position without regard for the law or reason.

Generally, the answer to this is that it is not advisable, however there is some controversy as to whether med/arb is preferable to mediation followed by arbitration with a new arbitrator, in the event that the mediation fails to fully settle all aspects of the dispute.
