One of the most underestimated aspects of estate planning is the emotional fallout that follows death.

People often prepare Wills as though families will suddenly become more patient, more understanding and more cooperative in grief. In reality, death has a way of amplifying unresolved tensions, old wounds, insecurities and financial anxieties.

I recently saw a discussion about a husband who solely owns a home and wishes, through his Will, to leave the property to his current wife and his two adult children from a previous relationship - all to “live there together.”

On paper, it may sound fair.
In practice, it can become a disaster.

Three individuals with different emotional ties, financial circumstances, expectations and lifestyles suddenly become bound together by a property they cannot freely control without the cooperation of the others. They become economic prisoners of an arrangement created by someone who is no longer here to manage the consequences.

What many testators fail to appreciate is this: after death, the filters disappear.

The things family members remained silent about out of respect for the deceased often come pouring out. Resentments surface. Distrust develops. Relationships fracture. Litigation begins.

A Will should not merely distribute assets.
It should minimize conflict, preserve dignity and create workable solutions for the living.

Sometimes that means having difficult conversations during life.
