Australians are being warned against using solicitors that are representing both sides in a property sale, with the Legal Services Commission receiving 11 complaints about conflict of interest in the past three years.

When asked to comment on the topic, Michelle said, “I truly believe that you can’t represent both parties in their best interests”. Michelle always has her clients’ best interests at heart and refuses to act for both parties in a property sale, noting it should be avoided at all costs. If any issues arise during the sale, it can be detrimental for both sides.

Did you know that South Australia is one of the three states in Australia where it is illegal for real estate agents to receive referral fees from conveyancers? This ban protects the consumer and ensures that agents are referring their clients to conveyancers based on the quality of their services, and not on the fees they will receive.

Did you know that cooling-off periods for property purchases are not mandatory Australia wide?

A cooling-off period is an amount of time after a buyer has signed a contract for a sale during which they are allowed to withdraw from the contract. During this time, there can be a number of reasons why a buyer might withdraw from the property purchase, including serious issues arising in the building or pest inspection, plans of infrastructure or housing developments in the area coming to light, a buyer's inability to secure finance from a lender, or just simply a change of heart.

According to Canstar, cooling-off periods across the country typically range from two to five business days, however, some states have no cooling-off periods at all. In South Australia, we are fortunate to have a mandated cooling-off period of two business days, allowing the buyer time to thoroughly evaluate the property and the contract terms. We recommend consulting a conveyancer at every step of your property purchase, from before you sign the contract to the settlement period.
