CAN POLICE SEARCH YOUR HOME BECAUSE YOU ARE SOMEONE'S ASSOCIATE?

A recent South Australian District Court decision highlights an important principle: police intelligence must be carefully assessed before it can justify a search warrant.

In this case, an allegation and an outdated database entry describing a person as an "associate" were not enough. The Court found that, without reliable and current information linking the occupant to criminal activity, police were relying on speculation rather than evidence.

Importantly, the Court also reinforced that an unlawful search cannot be retrospectively justified simply because incriminating evidence is later discovered.

It is a reminder that search powers are not unlimited and that courts will closely scrutinise the basis on which those powers are exercised.

WERE YOU DETAINED AT MAGILL, McNALLY OR THE SOUTH AUSTRALIAN YOUTH TRAINING CENTRE?

The recent arrest of a man accused of numerous offences connected with the former Magill Training Centre has again drawn attention to the abuse experienced by children detained there.
Websters Lawyers is currently acting for numerous survivors of abuse at Magill.

We know that many others have carried what happened to them for decades—sometimes without telling anyone and often without knowing whether they may still have legal options.

WHEN AI LEGAL ADVICE COSTS MORE THAN A LAWYER

A recent Court case highlights the risks of relying on artificial intelligence for legal advice. A self-represented litigant used ChatGPT to prepare submissions challenging a visa decision. While the arguments appeared sophisticated, he was unable to explain them when questioned by the Court.

The result? His case was dismissed, and he was ordered to pay more than $9,000 in legal costs.

AI can be a useful tool, but when it comes to legal matters, professional advice remains invaluable. What seems like a cost saving today can become a very expensive mistake tomorrow.

CAN YOU CLAIM COMPENSATION IS SOMEONE ASSAULTS YOU?

It took only seconds. A man crossed a crowded hotel, confronted another patron and pushed or grabbed him. The other man fell, fractured his leg and required significant surgery.

The person responsible later pleaded guilty to common assault. That was not, however, the end of the legal consequences. The injured man also brought a civil claim and was ultimately awarded approximately $463,000 in damages.

This recent Court decision highlights an important principle: a person who deliberately uses unlawful force does not necessarily have to intend the particular injury that follows before being liable to compensate the person injured.

DO YOU HAVE TO GIVE POLICE YOUR PHONE PIN?

A mobile phone can contain years of private messages, photographs, emails, financial information and location data. If police seize your phone and ask for the PIN, it can be difficult to know whether you have any choice but to provide it.

A recent South Australian District Court decision confirms that police may ask for a PIN, but a person ordinarily has the right to refuse to provide it. Police must not undermine that right by making the person believe that there is no choice but to hand over their PIN.
