MOBILE PHONE DRIVING CHARGES IN SOUTH AUSTRALIA UNDER SCRUTINY AFTER COURT RULING

A recent decision by a South Australian Magistrate has raised serious questions as to how police prosecute mobile phone use while driving charges. The Magistrate dismissed a charge against a driver, finding the prosecution’s evidence insufficient to prove the offence. This ruling has raised questions about the burden of proof in these cases and may offer a new avenue of defense for drivers facing similar charges. This article examines the decision, its implications for drivers in South Australia, and potential legal challenges ahead. 📣📣 The 2025 Websters Lawyers Intervarsity Competition has come to another exciting end!

On Saturday 6 September, our final Moot Court rounds were conducted at Flinders University City Campus and proved to be an enthusiastic and exhilarating event with many other supporters who were eager to see who would win the 2025 Title!

8 competitors in teams of 2 battled it out first thing in the morning for the Semi-Final round 🤩. This round was judged by Mark Roberts KC of Murray Chambers and Rose-Marie Read of Hugh Burton Chambers. 2 teams advanced through to the Grand-Final round in the afternoon and both finalist teams were from Flinders University! The Grand-Final Judges were His Honour, Chief Justice Kourakis and His Honour, Justice S Doyle who both had the tough task of selecting the winning team, and the overall winner of the competition.

🎉 Congratulations 🎉 to Hannah Esmaeili who was declared the ultimate champion, and Isabella Trigwell who earned the runner-up spot. Both Hannah and Isabella were on the same team. Mojtaba Shafaie and Chetan Changalasetty, the runner-up team also from Flinders University both delivered a strong performance as finalists. Both Hannah and Isabella have won the prestigious 8-week, fully-funded clerkship prize. We look forward to welcoming them to Websters Lawyers in late 2025/early 2026.

A special thank you to our incredible panel of judges who participated and took time out of their busy schedules to be involved in the Semi-Final and Grand-Final Rounds, as well as Law Society President special guest Marissa Mackie, all of whom provided invaluable insight and feedback throughout and following the competition. 🧑‍⚖️

We look forward to next year’s event with great anticipation, congratulations to the winners and well done to all other students involved. We encourage those who continue on with their studies next year to enroll into the competition and receive the chance to win a fully-funded clerkship which can provide the opportunity to immerse yourselves into a real-world legal practice and gain invaluable experience! 😍

WHEN CAN FINAL PARENTING ORDERS BE CHANGED? UNDERSTANDING THE COURT'S INCONSISTENT APPROACH

In May 2024, significant amendments to Australia’s Family Law system came into effect, introducing section 65DAAA into the Family Law Act 1975. This new provision was intended to clarify the rules around when final parenting orders can be reconsidered. However, recent court decisions have revealed inconsistencies in how this section is being interpreted and applied, leaving many parents confused about their rights and options. MOTHER BREACHED COURT ORDERS BY SECRET CHILD BAPTISM

A recent decision of the Federal Circuit and Family Court of Australia has brought into sharp focus the serious consequences that can arise when a parent makes major decisions about their child’s life without consulting the other parent. In this case, a mother was found to have breached court orders by having her young child baptised without informing or consulting the father. The Court’s ruling serves as an important reminder for all separated parents about the legal requirements of shared parental responsibility and the risks of acting unilaterally, especially in matters as significant as a child’s religion.
