Following a divorce in Australia, it is important to be aware that strict time limits apply to financial matters.

In most cases, parties have 12 months from the date a divorce becomes final to commence proceedings for property settlement or financial orders.

If this time limit passes, an application may still be possible, however court approval is required.

Understanding these timeframes is essential to ensuring your rights are protected.

A common misconception is that divorce resolves all legal and financial matters between parties.

In Australia, divorce is a separate legal process. Property settlement and parenting arrangements must be addressed independently.

It is also important to be aware that strict time limits apply to financial matters following divorce.

Understanding these distinctions early can help avoid delays, additional costs, and unnecessary legal complications.
