When it comes to facial recognition technology, simply telling customers they’re under video surveillance may not be enough.

The recent Administrative Review Tribunal decision concerning Bunnings’ use of facial recognition technology provides important guidance for Australian businesses, particularly around signage and notification, consent, privacy policies and governance.

While Bunnings successfully challenged the OAIC’s finding that it had unlawfully collected sensitive information without consent, other privacy breaches were upheld, including that its signage did not adequately notify customers about the collection and use of their biometric information.

With the OAIC also releasing updated guidance for businesses considering facial recognition technology, there are important lessons for businesses using (or looking to introduce) this technology.

Not every commercial dispute needs to end up in court.

In many instances, alternative dispute resolution (ADR) methods can be used effectively to resolve commercial disputes without resorting to litigation, or alongside litigation as part of pre-trial proceedings.

Businesses are encouraged to consider whether their dispute can be resolved through ADR before or during litigation, as it often provides a faster and more cost-effective pathway to resolution. Courts will also frequently order parties to participate in some form of ADR during proceedings.
