Plenty of Parentage Orders!

The making of a Parentage Order is the final legal step in a surrogacy arrangement. I’ve had the privilege of assisting countless teams with their Applications to the Youth Court of South Australia over the past five or so years, and I still love hearing the Judge make the Order. In that moment though, I hear far more than the law. I understand the uncertainty and persistence experienced by intended parents just to reach the point of entering into a surrogacy arrangement. I know the time, effort and patience poured into preparing for and completing the pre‑arrangement requirements. I know the mix of apprehension, anxiety and excitement that accompany a surrogate pregnancy. And I am truly blessed to know the pure joy of the baby’s birth and have witnessed the realisation on the face of the new parent that they are finally holding their child.

So when the requirements of the law are read out in Court and that Order recognising the intended parents as the legal parents of their child is made – I feel the joy, relief and gratitude that fill the courtroom and still get goosebumps! Over the last couple of months, I’ve had the pleasure of assisting in six Parentage Orders being made, with another two imminent. Huge congratulations to all the amazing SA teams! 🎉

I’ve just returned from a holiday in the UK… although in true lawyer fashion, I somehow ended up spending half my time exploring foreign courts instead of relaxing with family.

Liverpool surprised me with its use of a three‑person lay panel to sentence minor criminal matters — no judge in sight. Belfast’s Royal Courts of Justice, on the other hand, sit behind a heavy security fence still in place from past bomb threats. And the Isle of Man, small as it is, proudly runs its own self‑governing judicial system, completely separate from the UK.

I promise I did squeeze in some proper holidaying too — but there’s something endlessly fascinating about seeing how justice is shaped in different corners of the world.

It’s worth taking some time to consider where you get your information from, a qualified professional with experience or …. not?

If we want successful surrogacy in Australia, and to reduce the number of intended parents heading overseas, we need to regulate the industry.

👉 Lawyers, counsellors and clinicians are all held to professional standards, codes of conduct and licensing requirements before we open our doors.

😎 Accessible and ethical surrogacy must be supported by services that are accountable.

🙌 Matching services, and advertising for surrogacy, are illegal in many parts of Australia. There are very few protections for intended parents who hand over their money for promise of matching with a surrogate, that may not exist.

If we care about the rights of women and children, and to protect vulnerable intended parents from being exploited, we need to regulate the industry.
