Fixed-term contracts don't stay "fixed" forever — Section 12(3a) of the Labour Act.

Many employers assume that a contract stating a specific duration (fixed-term, casual, seasonal, or for a specific task) automatically ends employment at that date. Section 12(3a) says otherwise.

Once an employee has served a continuous period fixed by the relevant employment council or by the Minister of Labour where no council exists or none has set a period; that "fixed-term" contract automatically converts into a contract without limit of time (permanent contract).

The practical effect is that the employee becomes entitled to the same benefits as any permanent employee under the Act or the applicable collective bargaining agreement.

Rolling over casual, seasonal, or short-term contracts without checking the applicable continuous-service threshold can unintentionally create permanent employment relationships with all the obligations that come with them.

Did you know?

A company is a separate legal person from its owners and directors. This means that, in most cases, the company's debts and liabilities do not automatically become your personal responsibility.

However, this protection can be lost if the company is used improperly. Courts may "lift the corporate veil" and hold directors or shareholders personally liable where there is fraud, dishonesty, or abuse of the corporate structure.

NO WRITTEN CONTRACT? EMPLOYMENT RIGHTS MAY STILL EXIST.

Many employers and employees assume that if there is no written contract, there is no employment relationship. The law does not always agree.

Under Zimbabwean labour law, where a person performs work for another and receives, or is entitled to receive, remuneration, an employment contract may be deemed to exist — even if nothing was reduced to writing.

This principle protects workers from exploitation and reminds employers that labour obligations may arise from conduct and practice, not merely paperwork.

A written contract is always advisable, but the absence of one does not automatically extinguish rights and obligations.

If you are uncertain about your employment rights or obligations, seek professional legal guidance.
