FAMILY TRUSTS

We are living in an era of greediness and selfishness where families are being deprived of hard earned assets of their parents by intemperate relatives and friends. Quite apart from this, other unfortunate eventualities such as termination of marriages (divorces) are also threatening family assets. It has become imperative now more than ever before to resort to clear wealth or asset management techniques and processes within the permissible legal frameworks in Zimbabwe and many people are finding the avenue of family trust as a panacea to the aforesaid problems.

A Family Trust is a legal way that allows the founder to transfer his or her assets to another, nominate the trustee or group of trustees, who then manage and control the said assets for the benefit of selected or identifiable beneficiaries such as children, descendants or any other family members, individuals or institutions. This is done through registering a family trust deed through a lawyer who is a Notary Public.

In the family trust deed, the founder has the discretion of articulating a number of safety measures in the management of the assets which may remain binding at law even in their absence.

When you register a trust, you protect your assets against a number of threats in the event of death or divorce. Some of the advantages of registering a family trust include, but are not limited to:

*Articulation of succession or inheritance plans

*Promotion of peace and harmony within families in view of clear succession of inheritance plans

*Tax benefits

*Ensuring that your children do not face financial problems upon your death or divorce

*Protection of your assets from attachment as they are owned by a separate legal person that you would have created.
