WHAT IS ESTATE ADMINISTRATION
According to the Estates Administration ACT:
“work of an estate administrator” means any act performed by a person in a capacity as
(a)executor of the estate of a deceased person
(b)tutor or curator of a person under a legal disability or of such a person’s estate
(c)trustee or provisional trustee of an insolvent estate
(d)liquidator or provisional liquidator or judicial manager of a company
(e)agent of an executor, tutor, curator, trustee, liquidator or judicial manager

THAT THERE ARE PROPERTIES THAT MAY NOT BE SHARED IN THE EVENT OF A DIVORCE.

There is certain property that can be excluded from division upon divorce in Zimbabwe. This is provided for in terms of the Matrimonial Causes Act [Chapter 5:13]. There are types of property which if proved to the satisfaction of the court as meeting the exemption requirements may be excluded. The property which is subject to exemption from division upon divorce in Zimbabwe is as follows:

a. Properties acquired by way of inheritance;
b. Properties acquired in terms of any custom and which, in accordance with such custom, are intended to be held by the spouse personally; and

The list above is not exhaustive of the properties exempt.

We will begin with defining divorce and in the following posts discuss divorce related issues.

WHAT IS A DIVORCE?

It is defined as the legal termination of the marriage relationship.

A civil marriage (Civil Marriage formerly known as Chapter 37 ……. Chapter 5:11 and now known as the Marriages Act Chapter 5:17) in Zimbabwe can be terminated by an order of the High Court.
