As I was going through Prof. Eleanor Lissel's book on safeguard measures this morning, a thought hit me. Technological advancements have really made it easy to do a lot of things. Opportunities such as education, networks, and work have all been made readily accessible now more than ever. But at the same time, this generation has become less and less informed about topical issuesโ€”progressively passive consumers of information that adds no value and offers only temporal pleasure.

There are people who do not even know that there are currently armed activities between the US, Israel, and Iran. Maybe that could be more far-fetched or not directly from their country, but there are people who do not know anything about what is happening in the country they live in unless it is social media drama, someone's nudity being displayed, or trendy dance moves. This presents an inverse effect compared to the generations before us.
Even in an environment where access to information was difficult, previous generations wereโ€”and have remainedโ€”more informed than this one. We have access to an enabling environment, yet we are barely informed.

The multitude of AI tools out there is a prime example: we choose to use them to expose our laziness, confess our personal "feelings" to an algorithm meant to pleasure us at all times and agree with us instead of seeking actual human connection, or just 100% replace human effort and perpetuate this laissez-faire attitude toward our own personal growth and development.

As a youth, take this as a kingly reminder: Your environment is enabled. If you don't make proper use of it, your progress will be stunted, and you will find it difficult to exist in that environment.

It is can either be one of two things. You argue on the basis of the law or on the basis of facts. Being able to understand this simple but clearly important truth could possibly be the determining factor of winning or losing in trial advocacy.

Today I recounted on this really determining moment where I met my first real test as a mooter. It was an amazing experience.

In today's session, your favorite future international economics lawyer led the discussion, and what truly stood out as inspiring was how much more impact collective effort toward a common goal has than we often realize.

While preparing for class today, I had a reflection on this topic and global trade as we know it. There is a lot of darkness associated with the trade system, from the motivation to create it, its sustenance, and the geo-global politics associated with it. Africans were colonized and sold through slave trades because of the selfish wishes of some countries and regions to gain minerals and other valuables. Colonisation was legalised because of the contest among global superpowers to gain more control and build wealth under the flawed perception of the mercantilist mindset.

LEARNING RESOURCES, INC., et al. v. TRUMP, PRESIDENT OF THE UNITED STATES, et al.

The United States Supreme Court ruled that the President lacks the legal authority to unilaterally impose peacetime tariffs using the International Emergency Economic Powers Act (IEEPA). The majority opinion, led by Chief Justice Roberts, applied the major questions doctrine, asserting that such a significant expansion of executive power requires an explicit and clear mandate from Congress. While the government argued that the authority to regulate importation inherently included the power to tax, the Court maintained that the power of the purse is a core legislative function that cannot be delegated through ambiguous statutory language. Justice Gorsuch and Justice Barrett provided concurring opinions that explored the historical and textual foundations of this doctrine, debating whether it serves as a substantive constitutional guardrail or a tool for standard linguistic interpretation. Conversely, Justice Thomas and Justice Kavanaugh authored dissents, arguing that the broad language of the IEEPA and historical precedents regarding foreign affairs should allow the President greater flexibility during national emergencies.

The Supreme Court's ruling reinforces several foundational principles governing U.S. trade policy:

1. The Power to Tariff belongs Exclusively to Congress:
The Constitution (Article I, Section 8) strictly assigns the power to lay and collect taxes and duties to Congress alone. The President possesses no inherent authority to impose tariffs during peacetime, even to address international threats like drug trafficking or trade deficits.

2. Delegations of Trade Power Must Be Explicit and Constrained:
For the Executive Branch to impose tariffs, Congress must expressly delegate that authority. The Court highlighted that valid trade statutes (such as the Trade Expansion Act or the Trade Act) explicitly use terms like "duty" or "surcharge" and impose strict restraints on the President. These traditional constraints include tariff rate caps, time limits, and demanding procedural prerequisites like formal investigations and public hearings.

3. "Regulating" Imports Does Not Include "Taxing" Imports:
A broad statutory grant allowing the President to "regulate... importation" does not implicitly grant the power to levy tariffs. The Court concluded that while tariffs can achieve regulatory goals, the power to regulate commerce is fundamentally distinct from the revenue-raising power of taxation.

4. The "Major Questions Doctrine" Applies to Trade Policy:
The Court ruled that there is no "foreign affairs" or "emergency" exception to the major questions doctrine. Because imposing sweeping tariffs has profound "economic and political significance," a President must be able to point to "clear congressional authorization" rather than relying on ambiguous or vague statutory language.

5. Rejection of Unchecked Executive Trade Policymaking:
The decision protects the "longstanding executive-legislative collaboration over trade policy" from being replaced by unchecked, unilateral Presidential action. The Court warned that allowing a President to bypass traditional trade statutes to impose tariffs of unbounded amount, duration, and scope simply by declaring a national emergency would represent a "transformative expansion" of executive authority over the economy.

Why International Economics Law (IEL)?

It is a body of rules, agreements and principles that govern economic relations between countries. It specifically regulates how countries, Multinational corporations and international organisations engage in relations in areas such as International Trade, Foreign investment, International finance as well as sustainability in economic growth among others.
With the continued blurring line on globalisation, rise of trade system such as the AfCTA in Africa and the continued stride for sustainable development among others, the area of is increasingly relevant for one to consider. Behind the stats, behind the numbers,
There are livesโ€”real livesโ€”broken, changed, forever altered.
A life, pushed off its path, flipped onto a new axis,
Direction changed, future rearranged.

Itโ€™s not just skin deep, nah,
The bruise fades, but the mind?
The mind carries the weight, the silent screams, the unspoken painโ€”
Psychological shadows that cling,
Until help comes, or sometimes, until the light goes out.

Seventy-five percent, yeah, mostly women.
But that number? Itโ€™s not a number.
Itโ€™s a life. And around it, lives rippleโ€”kids in school, futures interrupted,
Homes meant to be safe, torn open,
Peace shattered and nowhere to hide.

And coping?
Forget it. Even healthy ways crumble when the hurt runs that deep.
